General damages increased; future treatment costs stayed unchanged
Malindi High Court increased the passenger's general damages for pain and suffering from KSh 800,000 to KSh 2,000,000. The other awards, including KSh 320,000 for future medical expenses, remained unchanged. Each party bore costs. The court examined the serious arm injury and the evidence supporting treatment costs. It did not award the higher private-hospital estimate requested on appeal. This was a reassessment of a Kaloleni judgment, not a standard tariff for all passenger injuries.
Obtain the complete medical record
A Kaloleni accident compensation lawyer needs the treatment notes, discharge documents and medical reports. Include records from every facility rather than only the final assessment. Identify follow-up care, rehabilitation and continuing symptoms. Explain any missing records so the advocate can advise how they might be obtained.
Keep the doctor's assessment separate from your own description of the injury. If reports differ, provide both. The lawyer needs to understand the nature of the injury and the evidential basis for any claimed disability. Do not substitute a similar case's diagnosis for the findings in your own medical record.
Explain the accident and the existing liability finding
Provide the police material, witness details and vehicle information available to you. Identify where you were travelling and how the collision occurred. If a court has already apportioned responsibility, bring the judgment and explain whether liability is part of the intended appeal.
A complaint about the amount of compensation differs from a complaint about who was responsible. Keep these issues separate in the enquiry. A lawyer should be able to see which findings are challenged and which remain accepted. A successful damages appeal does not necessarily reopen the entire liability dispute.
Document future treatment rather than choosing the highest estimate
Bring the proposed procedure and the medical explanation of why it is needed. Supply itemised estimates and identify the facility offering each treatment. Explain the basis for choosing a particular provider, including any relevant clinical needs. An advocate can assess whether the evidence supports the claimed future cost.
Keep surgery, medication, physiotherapy and other costs separate. Distinguish care already received from care still proposed. A private estimate being higher does not by itself establish that a court must award it. Likewise, a lower public estimate does not automatically answer every question about suitability or availability on another patient's facts.

Prepare a schedule showing the heads of compensation sought. Include receipts for expenses already incurred and evidence of earnings or work affected by the injury. Explain whether the complaint concerns lost income, reduced capacity to earn or another loss. These descriptions require supporting facts.
Do not add amounts from different reported cases into a personal estimate. Awards depend on the evidence, issues and procedural setting. An advocate can review relevant decisions while keeping your claim anchored in your own injury and losses. An amount requested in submissions should not be presented as the sum actually awarded.
Review the reasons for the Kaloleni award
Supply the signed lower-court judgment, proceedings and the medical evidence that was before the trial court. Identify the passages explaining the assessment of damages. If you seek an appeal, tell the lawyer exactly why you consider the assessment wrong, rather than only saying you expected more.
Add the memorandum of appeal and later orders if an appeal is already underway. Highlight the current deadline and any stay of execution. A historical successful appeal does not show that another award can be changed without a proper basis. Your adviser must review both the court's reasoning and the record supporting it.
Make the enquiry useful for individual assessment
State the accident date, injury, treatment facilities and current court file. Attach the judgment and principal medical reports. Explain which award you wish to challenge and whether you have received any payment. Give the advocate enough information to assess the procedural position and evidence before discussing fees or likely results.
