If you need help from a garsen divorce and unpaid water or electricity bills lawyer or advocate for a matter connected to Garsen Kadhis Court, start with the actual orders and documents. This article analyses FAA v RAD, decided by Garsen Kadhis Court.

A specific utility payment accompanied the divorce orders

Garsen Kadhi Court ordered dissolution on khulu grounds, issue of a divorce certificate and payment of Ksh 3,600 by the respondent for electricity and water bills. Evidence concerned shared utilities and a disputed understanding that rent included them. It did not award the separate food debt described by a witness. The reproduction carries a 2019 citation, a 24 July 2017 delivery line and a conflicting August date in its narrative; the operative orders are reported without resolving that inconsistency.

Separate each household debt from the divorce request

A divorce unpaid utility bills lawyer needs the bill, payment history and explanation of who was responsible for the charge. An advocate should understand whether you seek reimbursement for money paid, payment of an outstanding account or another financial order. Identify electricity, water, food and rent separately instead of combining them into one household figure.

Provide the pleadings if proceedings already exist. Explain which debts were actually included and which were merely discussed outside court. The adviser needs the scope of the current claim before assessing the available record. An order concerning one bill should not be described as a decision on every expense mentioned by a party or witness.

Obtain the tenancy and shared utility arrangement

Supply the tenancy agreement, rent receipts and messages concerning included services. State whether the premises had a separate meter or a shared account. A lawyer needs to understand how bills were allocated among occupants and what the parties were told. A general statement that rent included everything may not explain the actual payment arrangement.

If a landlord or neighbour managed contributions, identify that person and provide available records. Explain how the household’s portion was calculated. The advocate can assess the relevant evidence without assuming that the whole building’s arrears belong to the parties in the divorce proceedings.

Create an account that avoids double recovery

List each charge, due date, amount paid and remaining balance. Attach receipts or other payment records. An advocate needs to distinguish an unpaid bill from an expense someone else has already settled. Identify who made a payment and whether it was a loan, contribution or reimbursement according to the available evidence.

Where a relative paid a supplier, provide the relevant record and explain the arrangement. Do not silently treat that payment as still owed to the supplier. The lawyer can assess the proper financial complaint and the material supporting it. A transparent account is more useful than an inflated total that repeats the same expense under different headings.

Preserve evidence from people with direct knowledge

Identify witnesses who supplied goods, collected utilities or observed the payment arrangement. Explain what each person knows firsthand and retain relevant messages or records. An advocate needs evidence addressing the particular debt, rather than a general opinion about whether one spouse was responsible within the marriage.

Include the other party’s explanation and any documents supporting it. The adviser should understand the disagreement about inclusion of utilities in rent and about payments already made. Do not present a disputed assumption as an admitted fact merely because it was widely repeated in the household.

Read the financial and divorce directions individually

Provide the judgment, extracted orders and any later variation or appeal. Identify who must pay, the item covered and any compliance requirement. A lawyer should read the financial direction separately from the dissolution and certificate directions. A historical order in a published case should not be used as a standard amount for another household.

For consultation, send the tenancy arrangement, utility account, witnesses’ records and current court documents together. A lawyer and advocate can review the issue at Garsen Kadhi Court on its actual evidence. The FAA decision illustrates a particular utility payment made alongside divorce orders. It does not establish that every household debt must be paid by one spouse, award a food reimbursement in your case or resolve a dispute about a different tenancy and account.
