This guide explains Mgalo v Shiv Construction Co. Ltd and the documents to prepare for an independent consultation.
The appeal restored the hearing, not compensation
The dismissal occurred before a year of inactivity had elapsed and without a notice to show cause. The appeal succeeded, the dismissal and refusal to reinstate were set aside, and the work injury suit returned for determination on its merits. Each party bore its appeal costs. No injury compensation was awarded in this judgment.
Locate the operative dismissal order
A lawyer for reinstatement of a dismissed work injury claim needs the order that ended the proceedings and any later ruling on an application to reopen them. Obtain the court file number and complete copies, including the record of the relevant attendance. An advocate must know which decision is being challenged and what procedural steps have already been attempted. Describe when you learned of the dismissal and how that information reached you.
Keep a dated record of communications with the registry and former representatives. Include acknowledgements, letters, emails and screenshots that can be traced to their source. If a file could not be located, record each enquiry and response. Distinguish a missing physical file from a difficulty viewing an electronic entry; they require different evidence. Do not turn an undocumented recollection into a statement that a court lost the file.
Build a chronology from the actual proceedings
List the filing date, defence, hearing dates, adjournments and last recorded activity. Put the supporting proceedings or notice beside each entry. Mark dates when the court did not sit separately from dates when a party failed to attend. A lawyer should see what happened on the record before assessing the explanation for delay. Include any interval during which the matter was formally stayed and provide the order.
An advocate reviewing an older workplace injury file also needs the original filing papers and procedural history. Ask which route applies to that particular claim and whether earlier directions affected its progress. A restored historical case does not establish that every new work injury claim can begin in the same forum. The reader's filing date, existing orders and current procedural position require an individual assessment.
Check what notice was actually given
Collect every mention notice, hearing notice, notice to show cause and relevant cause list that you received. Preserve the service evidence and the address or account used. Explain the purpose stated on each document rather than assume all court listings mean the same thing. Record whether counsel or a representative attended and obtain the attendance entry where available. This gives an adviser a concrete basis to review a disputed notification.
If you contend that no notice reached you, tell the lawyer which records have been checked and which are still missing. Include notices received by your advocate even if you personally did not receive them. An advocate needs the complete communication trail, including material that may weaken the proposed argument. Accurate disclosure is more useful than a broad statement that there was no communication at any stage.

Reopening proceedings is only part of the practical work. Assemble the employment record, incident report, medical evidence, expense receipts and previously filed witness statements. Identify documents already admitted and documents merely retained in your own folder. Keep sensitive medical papers private for the consultation. A lawyer can then assess what remains necessary if the claim returns to a hearing, without confusing procedural relief with success on liability or damages.
Contact potential witnesses to establish whether their current details are available, without coaching their account. Note missing records and the person or institution that may hold them. An advocate should be able to discuss the readiness of the case alongside the proposed application or appeal. Restoring a claim without preparing its evidence can leave the original dispute unresolved and increase the time and expense of the proceedings.
Agree a realistic next step with an adviser
Bring the earlier application, supporting affidavit, response and ruling if reinstatement has already been sought. Identify the explanation advanced then and any new material separately. Ask a lawyer about the proper route, present time position, service, expected costs and evidence needed. An advocate should explain which work concerns reopening the file and which concerns the eventual injury hearing. Keep settlement correspondence available for a separate discussion where relevant.
