Court: High Court at Mombasa
The dispute
A cyclist was struck by a vehicle in Mombasa in March 2023. Medical evidence described a right-foot crush/degloving injury, medial-malleolus fracture, distal-fibula periosteal stripping and assessed twenty-five per cent disability. The magistrate found the defendants liable but awarded only KSh 200,000 and omitted several damages heads. The High Court identified errors in the treatment of the record and injuries, including a statement that defendants had not appeared despite their participation.
What the Court decided
The appeal substituted KSh 1 million general damages, KSh 14,100 proved special damages and KSh 170,000 future medical expenses, retaining lower-court costs and awarding appeal costs. The pleaded special figures exceeded the proved receipts. The Court discussed diminished earning capacity separately from a proved monthly-income claim; the final disposition did not give a separate additional earning-capacity amount. The historical award is not a current injury tariff.

Plead injuries and special damages accurately, prove expenses and distinguish a present symptom from the original injury. Future medical expenses require a pleaded foundation and appropriate medical evidence. Do not multiply an unproved claimed wage by remaining work years or duplicate earning-capacity compensation within general damages. First-appeal intervention must identify a material error or a manifestly inappropriate award.
Choose a document for the procedural task
Plaint for a Cyclist Right Foot Crush Injury and Future Medical Expenses
Complete parties, addresses for service, material jurisdiction and limitation facts, precise negligence or other particulars, related proceedings and prayers. Check Orders 3 and 4 for the required verifying affidavit, witness statements, list and copies of documents; complete summons, fee and lawful service. Special damages require particular pleading and proof. This specimen is substantive wording, not the entire filing pack. Trial plaint for the competent Mombasa magistrate court, with verifying affidavit, witnesses, documents, summons and service as required. Check the actual injury limitation period and any lawful extension; these historic facts do not authorise reopening the concluded source claim.
Cyclist Witness Statement on the Collision Treatment and Continuing Foot Limitations
Use the witness own truthful account, distinguish observed events from named information sources and identify bundle pages and authenticating witnesses. Follow the actual trial or succession witness directions. Additional evidence and statements require any applicable leave. An appeal ordinarily uses the admitted trial record; a new statement cannot be inserted without the proper procedure.
Memorandum of Appeal on an Inadequate Cyclist Injury Award and Omitted Expenses
Identify the exact lower-court judgment or ruling, operative decree, parties, concise grounds and requested disposition. Use the procedure for this particular appellate court: an ELRC appeal and a High Court or ELC first appeal are not Court of Appeal proceedings. Check limitation, any necessary leave or extension, record, fees, service and directions. Filing an appeal is not an automatic stay.
Cyclist Injury Special Damages and Future Treatment Evidence Schedule
This is an evidential or accounting aid, not an originating process or independent proof. Give dates, authors or custodians, admissibility status, actual document pages and transparent calculations. Label missing and disputed items. Obtain the applicable leave or directions for supplementary evidence, serve it and prevent duplicate credits or recovery. Trial evidence schedule; for an appeal replace filing caption and cite the admitted trial record. The schedule is not a medical report or proof of present treatment costs.
Cyclist Damages Appeal Submissions on Medical Evidence Receipts and Earning Capacity
Identify pleaded issues, admitted evidence and genuine record pages. Follow directions on length, authorities, filing and service. Submissions do not introduce exhibits or cure missing substantive prayers. Distinguish what a party sought from what the Court ordered, and an unsuccessful historical position from the actual holding.

The reproduced primary judicial text, reasons and operative orders were checked against the neutral citation and Mombasa proceeding heading. These are newly drafted educational reconstructions, not original signed pleadings. A proposed procedural correction is labelled separately from what was actually filed. No subsequent-order or licensed-advocate review is claimed; check the current law, authentic file and directions before use.
These documents are newly drafted educational reconstructions, not original filed pleadings or matters handled by our team. The original decision may identify participants; the specimens replace identifying details with bracketed fields. Losing positions remain marked unsuccessful. An advocate must adapt jurisdiction, evidence, prayers and procedure to the actual case.
