REPUBLIC OF KENYA

IN THE HIGH COURT AT MOMBASA

SUCCESSION CAUSE NO [reference]

IN THE ESTATE OF [DECEASED]

GROUNDS OF OPPOSITION

1. The Respondent opposes review to the extent it seeks restoration of the revoked grant or a final declaration that the Applicant owns the disputed land. Those remedies exceed the identified complaint that title-related orders were made without affording the purchaser a hearing.

2. The Applicant must identify a recognised review ground, the actual impugned order and a satisfactory explanation of delay. Review is not a general rehearing of the succession dispute or a substitute for an appeal on every contested legal conclusion.

3. Any dispute about purchase validity, root of title, fraud or competing interests requires the appropriate pleadings, evidence and competent forum. These grounds do not admit that registration establishes an indefeasible interest, nor deny the right to a fair hearing.

4. The Court must examine the actual service and participation record and any relevant appeal rather than deciding disputed facts on these grounds alone. A replying affidavit is required where factual assertions are contested. The precise scope of imported civil review procedure must be observed.

5. The Respondent requests that any relief be confined to the proved procedural defect and that the grant revocation and substantive title issues remain separately identified. The reported case granted that limited review; this specimen does not reconstruct a successful total opposition to all review.

Use and evidence notes

These are grounds of opposition to the actual motion, not a fact-finding preliminary objection or a replying affidavit. Tie each ground to the proper test and admitted record. Supply a separate authorised affidavit for disputed factual evidence where needed. Check court directions on response and service. Apply the Probate and Administration Rules and the actual succession Court directions, rather than assuming ordinary civil motion procedure. Protect any minor or person lacking capacity.

Supporting material: [date]; [author or custodian]; [description]; [bundle page]; [authenticating witness]; [admission or permission]. Attach genuine records only. This public specimen contains no exhibits, signatures, personal identifiers or sworn declaration.

Source facts and limits of the decision

A third-party purchaser sought review of a 27 May 2022 succession ruling that revoked a grant and directed cancellation of resulting land titles. The purchaser asserted registered interests in two subdivisions and lack of a hearing before those title-related orders.

Review succeeded only to the extent of the title-revocation orders and associated Land Registrar service direction. The grant revocation was not reversed, ownership was not finally determined and parties were left to the competent forum. Each party bore its costs.

Review under the probate procedure and imported review power must be distinguished from appeal and a land-title trial. The reported text includes inconsistent dates; verify the certified 2022 ruling, application and extracted orders. Lack of a hearing supports only the properly established review relief, not automatic restoration of the grant or proof of a valid purchase.
