REPUBLIC OF KENYA

IN THE ENVIRONMENT AND LAND COURT AT KWALE

JUDICIAL REVIEW CAUSE NO [reference]

REPUBLIC v [LAND REGISTRAR] EX PARTE [RIVAL CLAIMANT]; [HEIR] INTERESTED PARTY

GROUNDS OF OPPOSITION

1. The interested party opposes any prayer treating judicial review as an automatic declaration that the ex parte applicant owns the parcel. The challenged administrative registration and the disputed underlying proprietary rights raise distinct questions.

2. The rival accounts require examination of title origin, transfers, adjudication, green cards and survey records. Those contested factual issues cannot be resolved by assuming that the document supplied by one party is genuine and the other is forged.

3. The Kadhi succession order is disclosed and has not been cancelled by the present challenge to the registrar decision. The interested party reserves the lawful inheritance and ownership arguments in the appropriate forum, subject to that forum jurisdiction and proof.

4. A prohibition order, if justified, should preserve the identified property pending determination and should not be conditioned on the supposed consent of an owner whom the court has not yet identified. The order must state the dealings restrained and the duration or further-order condition.

5. Any amended relief or further evidential response must comply with the granted leave, statement scope and court directions. These grounds do not themselves prove disputed purchase, occupation or registry authenticity; such matters require an authorised affidavit and evidence.

6. RELIEF: refuse unsupported final ownership or criminal-fraud declarations; determine the process challenge on its proper grounds; preserve legitimate defences in the directed merits proceeding; and make an appropriate costs order. In the source, certiorari and preservation issued despite the opposition.

Use and evidence notes

These are grounds of opposition to the actual motion, not a fact-finding preliminary objection or a replying affidavit. Tie each ground to the proper test and admitted record. Supply a separate authorised affidavit for disputed factual evidence where needed. Check court directions on response and service.

Supporting material: [date]; [author or custodian]; [description]; [bundle page]; [authenticating witness]; [admission or permission]. Attach genuine records only. This public specimen contains no exhibits, signatures, personal identifiers or sworn declaration.

Source facts and limits of the decision

A claimant relying on an earlier title, charge history and searches challenged transmission to an heir under a Msambweni Kadhi succession order. The registrar acknowledged competing green-card material but effected transmission without notifying the rival claimant. Parcel area, map sheets, document authenticity and ownership were contested.

Kwale ELC quashed the transmission registration and resulting title, prohibited further transactions pending final ownership determination, and directed a merits case in the appropriate forum with available defences preserved. Each party bore own costs. The court did not declare the applicant owner or cancel the Kadhi succession judgment.

Distinguish article 47 and Fair Administrative Action Act process relief from ownership adjudication. Under the source Order 53 route obtain leave, a statutory statement and verifying facts affidavit, then the permitted substantive motion and service. The source expunged a further registrar affidavit filed without leave. Authenticity allegations require proof, not automatic findings of crime.
