If a land seller dies before completing the transfer, a Kisii property lawyer or land advocate must review the agreement, payments and estate position together. In Mary Akwam Nyantine v Florence Nyaronge, the court refused to compel transfer but ordered repayment of KSh 240,000. The unpaid balance and the purchaser’s own obligations shaped that outcome.

A purchase stopped before the land was transferred

The agreement concerned a portion of Wanjare/Nyambunwa/124 measuring 25 feet by 100 feet, at a price of KSh 380,000. The buyer paid KSh 200,000 initially. Evidence also addressed KSh 40,000 paid to the seller’s family after his death, intended to count towards the purchase price.

The claim sought specific performance, with a refund as an alternative. The family disputed aspects of the purchase account and the agreement. The eventual judgment should therefore be read for the relief granted, rather than assuming that the buyer’s preferred transfer order succeeded.

The agreement alteration did not decide the case by itself

Paragraph 13 accepted that there was a sale agreement and that the parties knew the land in dispute despite an apparent alteration of the parcel number. The court did not make a final forgery finding from that alteration. It focused on the transaction and the outstanding KSh 140,000.

A person searching for an advocate for a land sale refund in Kisii should keep all versions of the agreement and the documents identifying the portion. Explain any correction and who made it. An advocate needs evidence connecting the agreement to the land, rather than a reconstructed explanation supplied after a dispute begins.

Why the court refused specific performance

At paragraphs 14–18, the court treated specific performance as discretionary. The buyer had not paid the full contract sum or demonstrated willingness to pay the balance. The judge also considered the lengthy delay and appreciation in value when assessing whether it would be equitable to require the defendants to part with possession.

This was not a rule that every incomplete purchase can only end in repayment. The reasoning was tied to the claimant’s performance and the circumstances before the court. Show the advocate any tender of the balance, demand for completion and response from the estate representatives.

Separate the seller’s promised obligations from the purchaser’s own obligations. A file asserting only that the family refused transfer may omit the issue that ultimately matters. Where performance remains outstanding, the advocate needs to assess whether it can be demonstrated and what remedy the facts support.

The refund succeeded on the alternative prayer

Paragraph 19 rejected retention of both the land and the money. The court entered judgment for KSh 240,000, with interest at court rates from the date of filing suit until payment in full. The defendants were ordered to bear the suit costs.

The buyer had requested interest from November 2008, but that was not the date in the final award. A recovery schedule must follow the actual order. This analysis does not state that the defendants paid, that an auction occurred or that any later appeal was unsuccessful.

Handling gaps in the reported chronology

The published judgment contains inconsistent references in its procedural chronology and a numbering jump to a paragraph labelled 26. This article does not manufacture a corrected account of those dates. The agreement, payment and remedy analysis can be explained from the express findings and final order.

For a current estate-related purchase, bring the succession documents and identify the capacity in which each person acts. The advocate must determine the correct parties from the actual estate record. A relative’s relationship to the seller does not, by itself, explain authority to complete a transfer or answer a claim.
