Looking for a lawyer or advocate for road accident medical receipts and damages appeal at Bomet High Court? This guide explains Chebotuiya v Ngeno and the documents to prepare for an independent consultation.

The appeal changed both damages components

Bomet High Court reduced general damages to KSh1.5million and allowed KSh6,500 special damages, producing KSh753,250 after the agreed50:50 liability allocation. It rejected medical receipts bearing a different patient’s name without an explanation in the trial record. Lower court costs and interest remained the appellant’s responsibility; each party bore their own appeal costs. The judgment heading identifies Sotik CMCC46/2017, although an internal paragraph gives another number. The outcome is a historical award on that evidence, not a compensation quotation for another accident.

Match each receipt to the claimed expense

A road accident damages lawyer needs the pleadings and the documents supporting every expense claimed. Arrange invoices, receipts and payment confirmations by date and provider. An advocate should be able to trace who was treated, what service was charged and who paid. A total written on a separate sheet is less useful than an indexed bundle of the supporting records.

Check patient names, hospital references and dates before the consultation. If a discrepancy has an explanation, preserve the evidence supporting it and identify where the explanation appears in the proceedings. Do not alter a receipt to make it fit the claim. A lawyer can assess whether clarification, further records or another evidential step should be considered under the applicable procedure.

Keep injury evidence separate from expense evidence

Bring treatment notes, discharge documents, medical reports and any later assessment that you hold. Mark when each examination occurred and explain the treatment chronology. An advocate needs to distinguish evidence of an injury from evidence of money spent. A medical report may describe the condition without proving every payment listed in the claim.

Retain records of earlier conditions or incidents where relevant and provide a candid account to the adviser. Do not assume that every later symptom can be attributed to the accident without evidence. This preparation guidance gives no medical diagnosis or disability assessment. It helps organise the documents so that the professional reviewing the case can identify the disputed evidential questions.

Understand what the liability order actually says

Provide any liability consent and the order adopting it, together with the judgment. Identify whether the dispute is about responsibility for the accident, the amount awarded or the application of an agreed ratio. A lawyer should read the record before deciding which issue remains open. A damages appeal should not silently be treated as a new liability hearing.

Where several defendants or insurers are involved, state their roles and attach the relevant correspondence. Keep settlement proposals distinct from orders made by the court. This article does not apply the example ratio to another claim or promise a particular insurer payment. The adviser needs your actual consent, findings and enforcement position to assess the amount and next procedural step.

Compare the pleadings with the judgment

Bring the filed plaint, any amendment and the schedule of expenses, then identify the amount allowed under each heading. Note an item omitted or challenged and point to the supporting exhibit. An advocate needs to examine what was pleaded, what evidence was produced and how the trial court dealt with it. Do not substitute new recollections for the documents in the record.

For an appeal consultation, include the proceedings, exhibits and submissions as well as the decree. Explain the alleged error in concrete terms, such as an unsupported expense or an assessment said to use an inappropriate comparison. The purpose is to identify a reviewable issue on the actual record, not to guarantee that a higher court will choose your preferred figure.

Treat comparative awards as context

A lawyer may consider decisions involving comparable injuries, but a headline compensation amount is not enough. Different evidence, injury effects, dates and liability findings can change the comparison. Ask the advocate to explain which features matter to your case. Avoid choosing a previous award solely because its amount appears attractive or because it arose in the same county.

Do not use this2022 judgment as a current damages calculator. This article describes what the court decided then and the practical records to assemble now. A case-specific assessment must consider the current procedural position and materials available. Any scheduled hearing or enforcement step should be identified promptly, without assuming that requesting an appeal automatically stops execution.

Make the enquiry specific to the evidence problem

Use “Sotik accident medical receipts dispute — Bomet High Court damages appeal advocate”. Supply the file numbers, judgment, liability order and indexed expense documents. State the challenged component and any immediate date. Ask about the appropriate procedure, evidence and fees after reviewing the papers. The useful client enquiry concerns a defined compensation issue supported by records, rather than a promised payout.
