This guide explains In re Estate of Ibrahim Wekulo Murunga (Deceased) and the documents to prepare for an independent consultation.
The appeal turned on the registered joint ownership
Bungoma High Court allowed the appeal, excluding the jointly held property from the estate through survivorship. The surviving proprietor did not have to surrender its rent to the estate. The competing applications were resolved accordingly, with no application costs and each party bearing their own appeal costs. The judgment did not establish that every property bearing two names is held in the same legal form. Its judicial heading identifies Bungoma; delivery at Siaya is not a separate originating court.
Bring the register before calculating inheritance shares
A lawyer for a rental property included in a Muslim estate needs the title, official search and relevant registration history. An advocate should examine the form of ownership recorded, not simply the number of names appearing. Include available transfer documents and any earlier entry affecting the property. Keep an old search separately dated from the most recent search.
Explain whether the dispute concerns the ownership form, validity of an entry or the effect of death on the interest. Do not assume that a family description of shared ownership settles those questions. A consultation should identify what the register actually shows and which document supports the interest claimed before proposed inheritance fractions are applied to that property.
Identify the exact estate property and competing applications
Bring the succession petition, asset schedule, applications, responses and latest orders. A lawyer needs the parcel description used in each document and the capacity of each person making the request. Keep a demand to deposit rental income separate from a request to distribute the underlying land. They may require examination of different parts of the record.
An advocate should know whether the property is already included in a court order or only asserted to belong to the estate. Mark disputed ownership as disputed. Include any amendment to the inventory and explain why it was made. This guide establishes no reader's estate assets or beneficiary entitlement; the actual registration and succession documents must be assessed together.
Keep rent records complete while ownership is disputed
Prepare a ledger of tenants, periods, sums due and payments received. A lawyer needs to understand which building or parcel produced the income and who collected it. Include available leases, receipts, transfers and expenditure records. Keep rental receipts separate from deposits or unrelated payments, and explain any period for which the records are incomplete.
An advocate can compare that account with the current orders about income. This article authorises no withholding, diversion or distribution of rent in another file. Do not infer permission from a similar case title. The consultation should establish what your operative order requires and which income is actually covered before deciding how to address a demand or application.

Collect documents explaining how the property was acquired and registered. A lawyer needs to distinguish a survivorship argument from a claim to inherit as a beneficiary. State the basis on which you say the property belongs to you, and include the documents supporting that basis. Family status alone may leave the ownership question unanswered.
An advocate should assess the argument using the register and current proceedings. If another party alleges an invalid transfer, preserve the relevant papers without presenting the allegation as an established finding. Identify missing documents and their possible custodian. This preparation allows advice on the precise property question without treating a general inheritance rule as the answer to every registration dispute.
Present earlier orders and appeal grounds together
Bring the lower court ruling, extracted order, record of appeal and any previous decision invoked in the dispute. A lawyer should see what was actually decided and what the present challenge seeks to change. Keep a claim that an issue was already resolved separate from the document said to have resolved it. A remembered hearing is an incomplete substitute for the order.
An advocate needs the current appeal status and any temporary directions about the property or rent. State what has happened since judgment, including a later application or registry action. This guide supplies no filing deadline and does not determine whether an appeal remains available. Advice must address the actual procedural history and present orders in your own file.
Request a registration and succession review
Use “jointly registered rental property included in Bungoma Kadhi succession — lawyer and advocate for survivorship and rent review”. Share the title history, asset schedule, rent ledger and court orders privately. Explain the outcome you seek and any upcoming date. Ask about the proper court, evidence, options, costs and fees. This case promises neither exclusion of your property nor freedom from an existing rental accounting order.
