A Bungoma land advocate or lawyer should identify how entry began, what happened to the purchase and when occupation allegedly became adverse. In Wakwenje v Fulafu, unresolved payment evidence defeated the claim brought by the purchaser’s descendants.
The claim arose from an old purchase arrangement
The applicants relied on a transaction involving the original Bokoli/Chwele/751 parcel, described in the court’s analysis as 10.12 acres at a price of KSh 5,100 under an agreement dated 31 January 1969. They claimed entitlement through adverse possession to land in the later parcel history.
The evidence described a purchase followed by entry and lengthy family occupation. The applicants also advanced an account that four acres had been released and six retained following family arrangements. Those arguments did not remove the need to prove the legal basis and timing of adverse occupation.
Two versions of the agreement left the payment issue unresolved
At paragraph 18, the court examined two versions. One recorded a deposit of KSh 1,442 and a balance of KSh 3,658. The other recorded KSh 4,442 paid and KSh 658 outstanding. The judge found no evidence that the remaining balance under either version had been cleared.
The existence of different figures was not reported as a final finding that an agreement was forged. The decisive evidential point was the absence of proof of completion under either account. A land lawyer should keep disputed versions separately and explain where each came from.
For an inherited purchase dispute, collect receipts, acknowledgments and correspondence from the original transaction where available. Identify what surviving witnesses actually know. A descendant’s account of long occupation may be important but does not automatically establish payment made decades earlier.
Permission and adverse occupation are different questions
Paragraph 16 discusses occupation under a purchase arrangement and the circumstances in which it may become adverse, including termination of permission, repudiation or completion in the principles cited. The court applied those principles to the applicants’ uncompleted purchase account and rejected their claim.
Someone searching for an adverse possession advocate in Bungoma should prepare a chronology rather than only calculate years since entry. Identify the owner’s permission, terms of entry, payments, alleged repudiation, demands, interruptions and earlier proceedings. The proposed start date needs supporting facts.
This judgment should not be converted into a universal rule that every purchaser with an unpaid balance can never establish adverse possession. Its result followed the evidence and reasoning in this case. The advocate must assess the particular occupation history and applicable authorities before recommending a claim.
The case was dismissed with costs
Paragraph 19 dismissed the originating summons with costs to the respondents. It did not order transfer to the applicants. The defence had also raised res judicata, but this analysis does not describe that argument as the decisive ruling: the operative reasoning focused on failure to pay the purchase balance.
For a client considering another case after earlier litigation, provide all prior pleadings and orders. Those records allow an advocate to assess the procedural history independently. Omitting an earlier file can obstruct assessment even where a particular reported judgment resolved a different issue.

- All versions of the original sale agreement.
- Payment acknowledgments and evidence of any alleged settlement.
- Parent and later parcel registers.
- Records explaining entry and continued occupation.
- Documents supporting the claimed change from permission to adverse possession.
- Previous court proceedings and estate representation documents.
Separate contractual completion, a possible repayment claim and adverse possession. They are different routes requiring different proof. This judgment decided the adverse possession suit; it should not be presented as an award of alternative contractual compensation.
