This guide explains Onyaka v Bungomaline Safaris Ltd and the documents to prepare for an independent consultation.
The adopted award remained in place
The employer's setting-aside application was dismissed with costs to the employee applicant. The court distinguished the DOSH award from its adoption and found no triable issue warranting setting aside. Conditional stay had already been discharged for unmet security. Inconsistent accident and award dates in the reproduction are avoided; this guide does not recalculate the award.
Collect the assessment and adoption documents
A lawyer for an unpaid work injury award needs the Director's decision, notification records and the later court application. Include the adoption ruling and decree if available. An advocate should establish which decision is being questioned: assessment of compensation, notice procedure or the subsequent court order. Different documents may answer different parts of the dispute.
Keep originals safe and supply readable copies for consultation. If you have only a demand letter stating an award amount, say that the underlying assessment is missing. Note the issuing office and reference shown on each document. This preparation helps the adviser identify the current stage without assuming that every demand has already become an enforceable court judgment.
Document employment and the work incident
Collect the contract, pay records, duty allocation and accident report relevant to your claim. A lawyer should know who assigned the work, who paid you and which legal entity you identify as the employer. Keep a company and a related cooperative separately identified. Similar trading names or shared premises may require examination rather than an assumption about responsibility.
An advocate needs your account of the incident alongside the documents available to support it. Mark disputed facts clearly and explain your source of knowledge. A vehicle record alone may leave the employment arrangement unresolved. This guide makes no finding about your employment or accident; the evidence should allow an adviser to assess the precise issue raised and the proper procedure.
Preserve notice and service evidence
Keep letters from DOSH, email messages, delivery records, affidavits of service and court notices. A lawyer needs to compare the recipient, address, attachments and dates shown in those records. Retain the complete message where possible rather than a cropped image of the subject line. Identify which recipient is said to have received each communication.
An advocate should examine both a denial of service and the material supporting service. State when you first learned about proceedings and how you responded. Avoid describing disputed delivery as an established fact solely because one side asserted it. A useful consultation bundle includes the notices themselves, the service material and the later steps taken after actual knowledge.

Bring any objection, appeal or review papers already submitted and the resulting decision. A lawyer should understand what was challenged, where and with what outcome. An objection about whether someone was an employee differs from an application directed at the court's procedural order. State the question you want determined instead of asking generally to cancel everything.
An advocate must assess the appropriate route on the current record. This guide gives no objection period and does not establish that an omitted step can still be taken. Include the date of receipt and any explanation for delay. The consultation should consider both the substantive concern and whether the proposed procedure can properly address that concern.
Read temporary protection and security conditions carefully
Collect every stay order and any later discharge or variation. A lawyer needs the precise condition, deadline and proof of compliance shown in your file. Keep a proposed deposit separate from a completed deposit supported by a receipt. Explain any failure to meet a condition and provide the relevant correspondence rather than assuming the protection continued.
An advocate should compare the latest order with an auctioneer's notice or proposed enforcement step. Identify the action and date requiring attention. This article authorises no seizure, obstruction or disregard of an order. Advice should establish what protection currently exists, what lawful steps remain available and what financial consequences may accompany the proposed application.
