The stay depended on compliance with payment conditions
Leave for the appeal and a stay were granted. The order required half the decree sum to be paid to the respondent and half deposited jointly within30 days, with automatic lapse for default; filing and service were ordered within14 days. These periods belonged to this ruling. The reproduction gives conflicting application dates and delay descriptions; verify the filed record rather than generalising its chronology.
Obtain the decree and current enforcement record
An accident decree stay lawyer needs the judgment, decree and any enforcement documents received. An advocate should be able to identify the amount ordered, the parties bound and the steps currently threatened or underway. Bring auctioneer notices, warrants and correspondence where relevant. Keep an informal demand separate from a document issued in the proceedings, and record when each item was actually received.
Prepare a timeline of the judgment, requests for copies and later action. A lawyer needs to assess whether an appeal exists, whether time has passed and whether a stay has already been sought. Include applications, responses and directions from the court. An intention to appeal does not explain the current enforceability of the decree. The consultation should begin with the actual order and procedural position rather than an assumption that negotiations have stopped execution.
Explain the delay using documents and dates
Gather requests to the registry, acknowledgements and messages with the insurer or adviser about the proposed appeal. An advocate needs the complete sequence and the date on which each step occurred. If you received the judgment later, preserve evidence of receipt and explain what happened afterwards. Avoid using a vague reference to investigation or insurance discussions as a substitute for an account of the whole period.
A lawyer can assess whether the explanation is supported and which material is missing. Where correspondence records inactivity or a different date from your recollection, include it and explain the discrepancy honestly. Do not copy the chronology or outcome of another extension application into your own account. The adviser needs facts from your file to evaluate the proper request and current legal requirements before proposing any further court step.
Assess a security proposal before offering it
Identify the source of any proposed deposit and obtain the insurer's written position if it is expected to provide funds. An advocate should know whether payment is approved, conditional or merely under discussion. A willingness to provide security may differ from the ability to comply with a specific order. Keep the commitment, amount and timing clear so that the adviser can assess the proposed arrangement realistically.
If the court has already imposed conditions, obtain the exact wording and prepare a compliance checklist based on that order. A lawyer needs to distinguish payment to the opposing party from a deposit held in a joint account. Preserve bank confirmations and the communications needed to establish each step. Do not assume that one transfer satisfies both requirements or that a proposed full deposit automatically matches the conditions ultimately ordered.

Bring the draft or filed appeal and identify the aspects of the accident judgment you challenge. An advocate needs to assess those grounds using the evidence and decision. A security arrangement does not establish that the appeal will succeed, and a stay does not reverse the judgment. Keep the merits bundle distinct from the documents showing filing, service and compliance with any interim conditions.
Explain the practical risk you say requires protection and provide supporting material. A lawyer should assess it without treating ordinary enforcement as proof of an additional loss. Record payments already made and update the outstanding balance. The adviser's assessment may need the current decree and later events together. This helps avoid seeking relief against a balance that has changed or describing an earlier proposed condition as the operative order.
Monitor the actual conditions and later directions
If a stay is granted, record its duration, conditions and any event that affects it. An advocate needs prompt information about difficulties completing a payment or filing step. Do not assume that an uncompleted requirement can be ignored because the appeal is being prepared. Ask for specific advice on the current order and available procedure before deciding how to address a genuine compliance problem.
Finish the consultation by identifying who will obtain the documents, handle filing and confirm service or deposits. A lawyer should explain the evidence needed to record completion and the consequences stated in the particular order. The percentages and periods in this case are not standard conditions for every accident appeal. Keep copies of acknowledgements and later orders so that the advocate can assess the current position as the appeal proceeds.
