Decision analysed: Wangila & another v County Government of Bungoma & another — [2026] KEHC 5623 (KLR) — 23 April 2026

Court: High Court at Bungoma

The dispute

Estate representatives held a fatal-accident decree from Bungoma CMCC 559/2018. They obtained certificates and served payment material on the county before seeking Order 53 leave and mandamus. The county said the application was premature because the applicants had dealt with the insurer. Amounts and motion dates in the reproduction conflict.

What the Court decided

Bungoma High Court accepted compliance with Government Proceedings Act section 21 and issued mandamus to honour the decree, with application costs against the respondents. It rejected the insurer prematurity defence. Although civil jail appeared in requested prayers, the operative orders did not commit any official.

What this decision does and does not establish

Use certified judgment, decree, costs and certificate of order against government, correct service and the actual responsible public duty. Reconcile amounts from originals rather than inconsistent reproduction arithmetic. An existing-decree mandamus motion is distinct from a contempt application after disobedience. Section 21 restrictions cannot be bypassed through ordinary attachment of public assets.

Choose a document for the procedural task

Application for Leave to Seek Mandamus on an Unpaid County Decree

Use the actual existing cause, applicable power and precise interim or substantive prayers with genuine supporting evidence. Disclose adverse facts, earlier applications, current orders and delay. Complete affidavit, exhibits, urgency certificate only where justified, fee and service under current directions. A proposed corrected motion does not establish that the missing facts or procedural permission exist. Check Order 53 leave requirements, statement, verifying affidavit, notice and the period and service directions for the substantive motion. This is not a contempt application.

Judicial Review Statutory Statement for County Decree Payment

For Order 53 leave proceedings, state applicant name and description, the specific relief and grounds. Provide the separate affidavit verifying facts and leave application. At the substantive stage comply with the granted leave, statement scope, filing and service directions. The statutory statement is a pleading and is not sworn evidence.

Verifying Affidavit on County Judgment Certificates Service and Unpaid Balance

Complete the deponent identity, authority and actual personal-knowledge or identified-information basis. Index and authenticate genuine exhibits; missing exhibits are not supplied by this text. An affidavit is evidence, not a vehicle for new unpleaded relief or invented expert conclusions. Obtain any required leave for a further affidavit and complete a valid jurat before a competent authorised person. This specimen is unsworn.

Substantive Mandamus Motion to Honour a Certified County Decree

Use the actual existing cause, applicable power and precise interim or substantive prayers with genuine supporting evidence. Disclose adverse facts, earlier applications, current orders and delay. Complete affidavit, exhibits, urgency certificate only where justified, fee and service under current directions. A proposed corrected motion does not establish that the missing facts or procedural permission exist.

Mandamus Submissions Answering the County Insurer Prematurity Defence

Identify pleaded issues, admitted evidence and genuine record pages. Follow directions on length, authorities, filing and service. Submissions do not introduce exhibits or cure missing substantive prayers. Distinguish what a party sought from what the Court ordered, and an unsuccessful historical position from the actual holding.
