REPUBLIC OF KENYA

IN THE HIGH COURT AT KISII

CIVIL APPEAL NO [reference]

[APPELLANT] v [RESPONDENT]

WRITTEN SUBMISSIONS

1. The first appeal requires reassessment of the admitted trial evidence with allowance for the trial court seeing the witnesses. The issues are duty, proved breach, causal connection and remedies within the actual plaint.

2. The operation and anaesthetic records at [pages] must be evaluated against the qualified testimony. The Appellant relies on the proved monitoring and management deficiency, not an unsupported assertion that spinal anaesthesia required reversal.

3. The regulatory findings inform the factual inquiry but do not conclusively determine civil negligence. Licensing defects and adverse outcome alone are insufficient; the Court must connect the proved departure from reasonable care to the loss.

4. Hospital responsibility is assessed from acceptance for treatment and the acts of the actual staff. Alternative causes and the postmortem explanation are addressed fairly on their evidence, rather than omitted because they are adverse.

5. The relief is confined to pleaded professional-negligence damages and proved special expenses. Unpleaded Law Reform or Fatal Accidents heads and unrelated legal fees cannot be inserted through submissions; interest dates must follow the applicable order.

6. The Appellant asks for reversal and the proved relief with appropriate costs. The 2022 result was followed by stay and later procedural rulings; this historical argument is not a statement that the decree is currently enforceable or that a further appeal has concluded.

DATED at [place] on [date]. Signed [party or advocate]. DRAWN AND FILED BY [name and address for service]. TO BE SERVED UPON [each affected person and address].

Use and evidence notes

Identify pleaded issues, admitted evidence and genuine record pages. Follow directions on length, authorities, filing and service. Submissions do not introduce exhibits or cure missing substantive prayers. Distinguish what a party sought from what the Court ordered, and an unsuccessful historical position from the actual holding.

Supporting material: [date]; [author or custodian]; [description]; [bundle page]; [authenticating witness]; [admission or permission]. Attach genuine records only. This public specimen contains no exhibits, signatures, personal identifiers or sworn declaration.

Source facts and limits of the decision

An estate representative challenged dismissal of a claim arising from death during caesarean surgery. The regulatory inquiry, operation notes, anaesthetic chart and conflicting medical explanations were examined. The High Court rejected the reversal-of-spinal-anaesthesia explanation but found negligent management of vital signs and hospital responsibility.

The 2022 appeal awarded KES 2,000,000 pleaded general damages for professional negligence and KES 157,000 special damages, with appeal costs and the stated interest dates. Unpleaded Law Reform and Fatal Accidents heads and unrelated legal fees were not awarded. Later rulings granted stay pending Court of Appeal proceedings, required proper post-judgment advocate-change procedure, and in September 2025 rejected the requested review of stay while permitting advocate change.

A regulatory misconduct finding is distinct from civil negligence and causation. This case does not establish that any surgical death or licensing defect automatically proves causation. Historical trial leave on limitation was case-specific. The 2022 merits result is not presented as presently executable or finally resolved in the Court of Appeal; later orders are linked.
