REPUBLIC OF KENYA

IN THE ENVIRONMENT AND LAND COURT AT MERU

ENVIRONMENT AND LAND APPEAL NO [reference]

[ALLEGED VENDOR APPELLANT] v [BUYER RESPONDENT]

WRITTEN SUBMISSIONS

1. The appellant relies on the grant and agreement chronology. The disputed transaction preceded confirmation of the estate shares, and the appellant was not the personal representative authorised to deal with the estate immovable property. The subsequent grant documents do not retrospectively supply missing authority.

2. Sections 45, 55 and 82 of the Law of Succession Act must be applied to the actual estate interest and transaction. The Court is asked to assess the civil consequences on the pleaded record, not to pronounce a criminal conviction through these appellate submissions.

3. The refund issue requires its own pleaded and proved foundation. The respondent must connect the amount, recipient, date and legal basis to the appellant. A family member benefit or payment of another decree is not self-proving receipt by the appellant.

4. The trial pleadings and admitted payment records at [pages] are compared with the monetary decree. Special damages require adequate particulars and proof. A demand letter supplies the amount demanded, but does not alone prove payment or liability.

5. The appellant addresses the buyer adverse evidence and the actual transaction interpretation. Invalidity does not establish that no restitution could ever be available against a proper recipient on a correctly pleaded case; the requested reversal concerns the failure of this particular claim and record.

6. The appellant requests that the unsupported monetary result be set aside and appropriate costs awarded. Meru ELC allowed the source appeal with trial and appeal costs. These submissions add no new receipts, grant or evidence to the admitted appellate record.

Use and evidence notes

Identify pleaded issues, admitted evidence and genuine record pages. Follow directions on length, authorities, filing and service. Submissions do not introduce exhibits or cure missing substantive prayers. Distinguish what a party sought from what the Court ordered, and an unsuccessful historical position from the actual holding.

Supporting material: [date]; [author or custodian]; [description]; [bundle page]; [authenticating witness]; [admission or permission]. Attach genuine records only. This public specimen contains no exhibits, signatures, personal identifiers or sworn declaration.

Source facts and limits of the decision

A buyer alleged purchase of half an acre of estate land from a widow/beneficiary for KES 620,000, with a KES 134,456 deposit. The widow said the document was represented as a lease and denied receipt. Payments allegedly discharged a son court debts. The April sale preceded July/August grant confirmation material. The trial at Githongo granted monetary relief.

Meru ELC allowed the widow appeal, awarding lower-court and appeal costs. It held the transaction lacked estate authority at that date and a later grant could not validate it retrospectively. The pleaded and proved link between the widow, payment, breach and special damages did not support the refund result on that record.

Separate contractual transfer, estate administration and restitution. The ruling does not bar every properly pleaded recovery after an invalid sale, and it does not convict a party of a crime. Source payment totals, dates and statements conflict; use originals. Trial specimens belong to the designated Githongo magistrate and appeals to Meru ELC, subject to actual jurisdiction and deadlines.
