REPUBLIC OF KENYA
IN THE SMALL CLAIMS COURT AT MILIMANI, NAIROBI
CASE NO [number] OF [year]
[Claimant] — CLAIMANT
VERSUS
[Respondent] — RESPONDENT
REQUEST FOR DIRECTIONS ON WRITTEN DETERMINATION
The Claimant requests directions under section 30 of the Small Claims Court Act on determination by written material, subject to the Court being satisfied that the procedure is appropriate and each party has a proper opportunity to be heard.
The proposed documentary issues are: the insurer’s repair authority, completion of the work, delivery of the satisfaction and release documentation, the invoice balance and any payment or credit.
The Claimant proposes filing [indexed authorisation, completion, invoice and demand bundle] with a signed statement by [witness able to identify the records], and serving it on the Respondent by the method directed by the Court.
The Respondent should have a period fixed by the Court to file its response, payment or credit records and objections to authenticity or completeness. The Claimant requests a further opportunity to answer new matters if the Court directs.
If a material fact requires oral evidence or cross-examination, the Claimant asks for that issue to be listed for the appropriate hearing rather than treating this request as a waiver of the Court’s control of the proceedings.
The Claimant therefore asks for directions on the mode of determination, filing and service sequence, timetable and any oral issues reserved. This request does not ask for automatic judgment merely because written determination is proposed.
DATED at [place] this [day] of [month] [year].

Purpose and correct procedural stage
Looking for a request for directions on written determination for unpaid insurer-authorised garage repairs in Nairobi? This page provides a reconstructed draft for Milimani Small Claims Court, with editable Word and PDF downloads. A Kenyan lawyer or advocate can adapt the document to the correct party, evidence and procedural stage.
Use the formal section only after completing the fields from the actual record. The educational notes and later outcome are separate from the draft and should not be filed as allegations that existed at the earlier stage. Keep the actual party’s legal position: Garage representative.
Evidence and adaptation checks
Repair authority: Contractual authority and recipient of the payment obligation. Record to locate: Insurer’s authorisation letter, with its payment conditions.
Invoice and work records: Scope of authorised work and charge claimed. Record to locate: Repair invoice and available completion records.
Completion and delivery: Completion conditions and commencement of payment period. Record to locate: Satisfaction note, release record and evidence of delivery to insurer.
Demand and account: Outstanding balance and payment request. Record to locate: Demand, delivery proof and credits ledger.
The judgment’s references to the authority date are not fully consistent. Use the actual letter rather than choosing a date from the narrative. Do not turn this into a third-party accident compensation claim.
What happened later — educational context only
The garage obtained an award for the repair invoice. The decision turned on the authority and completion records, with the insurer providing no evidential answer to the established debt.
The sample was drafted retrospectively from the published reasons. It is not evidence that these exact words, schedules or documents were filed in the source proceedings. Factual assertions must be verified independently before any real filing.
