If you need a judgment appeal settlement consent lawyer or advocate for a matter connected to Dagoretti Law Courts, Nairobi, start with the actual orders and documents. This article analyses Flawless Empire Limited v Kitchen and Beyond Limited, decided by Kibera High Court.

The appeal ended with a recorded agreement

Flawless Empire arose from a Dagoretti judgment delivered on 6 July 2026. In the High Court at Kibera, the appellant had sought stay of execution. The parties subsequently presented a consent dated 21 September 2026, which the court adopted on 22 September.

The short ruling does not publish the consent's terms. It therefore cannot support a claim that the debt was reduced, execution was suspended indefinitely or payment was completed. The practical issue here is reading and documenting a settlement during an appeal, rather than treating an unpublished agreement as a general stay rule.

Obtain the actual consent

A settlement consent lawyer needs the signed document, the order adopting it and the judgment it addresses. A message that the parties settled may leave important questions unanswered. Identify every page and attachment forming part of the agreement. If the version in your possession is a draft, label it as a draft rather than a concluded order.

Compare the parties and case references in the agreement with the underlying proceedings. Where a business changed its trading name or representative during negotiations, provide the relevant correspondence. An advocate reviewing the settlement needs to know who committed to what, without assuming that an associated company or another participant was automatically included.

Identify the matters covered

Set out the issues you understand the settlement to address, using its wording. Payment, execution, costs and disposal of the appeal can be separate provisions. Do not infer that one has been resolved merely because the agreement mentions another. Supply the complete order where your concern involves a condition attached to a procedural step.

Explain whether the document addresses the original judgment, an interim application or both. Keep any remaining disagreement in a separate note. The adviser can compare the scope of the consent with the current court file, rather than assume that a short public ruling explains every obligation negotiated privately by the parties.

Keep the negotiation and adoption records

Preserve the correspondence identifying agreed terms and the date on which they were presented to court. Distinguish a proposal from acceptance and acceptance from judicial adoption. That sequence can matter when one party says the understanding was different from the wording eventually recorded.

Provide the authority documents already available where a company representative signed. Do not create a retrospective record suggesting authority was obtained earlier if that is disputed. The advocate can review the actual material and identify what remains uncertain. This article does not decide whether a particular consent can be challenged or varied.

Record compliance without assumptions

Where the settlement requires payment, assemble receipts and the agreed schedule. Mark the amount actually paid and the date, keeping a promise to pay separate from payment. If performance involves another act, such as delivery of a document, preserve the evidence of that act and any acknowledgement.

Keep later court directions and execution correspondence with the settlement file. A consent's adoption does not by itself prove that all obligations were fulfilled. Explain which obligation you believe remains outstanding and which document supports that belief. A specific chronology is more useful to the reviewing advocate than a general claim that the other party breached everything.

Bring a precise question to the advocate

For a Dagoretti judgment appeal enquiry, identify whether you need help interpreting recorded terms, documenting compliance or addressing a dispute about implementation. Supply the consent, adopting order, original judgment and latest notice. Avoid relying on terms inferred from the title of another party's case.

Flawless Empire shows that an appeal application may conclude through a consent adopted by the reviewing court. Its published ruling leaves the agreed terms unstated. A lawyer must examine your own documents before assessing an obligation, deadline or remaining procedural step. The ruling is not evidence of a universal debt waiver or an automatic right to halt execution.
