Decision analysed: In re Estate of Naja Jehangir Austin (Deceased) — [2025] KEHC 9157 (KLR) — 19 June 2025

Court: High Court at Mombasa

The dispute

An estate originating from a 1972 death included a one-third undivided interest in a Mombasa property. The sole holder of the unconfirmed 2020 grant died in 2021. A grandson sought a de bonis non grant; an objector claiming a foster relationship through another deceased son opposed appointment.

What the Court decided

The Court revoked the inoperative grant, appointed the grandson to administer the unadministered estate and dismissed the objection. He was directed to collect and gather assets without distribution before confirmation. The objector contested family status was left for subsequent proceedings; each party bore its costs.

What this decision does and does not establish

Section 76(e), appointment priority and probate procedure address the death of a sole administrator. Separate estates and their shares must not be conflated. Because the original death predated 1 July 1981, section 2(2) requires checking the applicable historical substantive succession law; administration and confirmation remain distinct. This case does not establish a universal exclusion of foster or adopted children.

Choose a document for the procedural task

Petition for a De Bonis Non Grant after Administrator Death

Use the prescribed grant petition and affidavit, full inventory, deaths, family and interested-person disclosure, appointment priority, required consents or citations, notices and related causes. Address the existing grant and remaining administration expressly. Appointment does not authorise distribution before confirmation. Use the applicable petition and affidavit forms, full inventory, notice and consent procedure. Address revocation of the useless grant expressly; the historical Court overlooked an omission, which is not a filing shortcut. Apply the Probate and Administration Rules and the actual succession Court directions, rather than assuming ordinary civil motion procedure. Protect any minor or person lacking capacity.

Affidavit Supporting Replacement Estate Administration

Complete the deponent identity, authority and actual personal-knowledge or identified-information basis. Index and authenticate genuine exhibits; missing exhibits are not supplied by this text. An affidavit is evidence, not a vehicle for new unpleaded relief or invented expert conclusions. Obtain any required leave for a further affidavit and complete a valid jurat before a competent authorised person. This specimen is unsworn. Apply the Probate and Administration Rules and the actual succession Court directions, rather than assuming ordinary civil motion procedure. Protect any minor or person lacking capacity.

Separate Estates and Unadministered Property Share Schedule

This is an evidential or accounting aid, not an originating process or independent proof. Give dates, authors or custodians, admissibility status, actual document pages and transparent calculations. Label missing and disputed items. Obtain the applicable leave or directions for supplementary evidence, serve it and prevent duplicate credits or recovery. Apply the Probate and Administration Rules and the actual succession Court directions, rather than assuming ordinary civil motion procedure. Protect any minor or person lacking capacity.

Objection to Replacement Grant Based on Contested Family Status

Use the applicable prescribed objection and subsequent answer and cross-application process under sections 68–69 and probate rule 17, including proper service and directions. Establish standing and disclose contested family status accurately. This substantive specimen is not a complete prescribed filing form. This is an unsuccessful historical position reconstructed for instruction. Use the proper section 68–69 and probate rule 17 objection, answer and cross-application process; grounds of opposition alone are not the prescribed objection form. Apply the Probate and Administration Rules and the actual succession Court directions, rather than assuming ordinary civil motion procedure. Protect any minor or person lacking capacity.

Submissions on an Inoperative Grant and De Bonis Non Appointment

Identify pleaded issues, admitted evidence and genuine record pages. Follow directions on length, authorities, filing and service. Submissions do not introduce exhibits or cure missing substantive prayers. Distinguish what a party sought from what the Court ordered, and an unsuccessful historical position from the actual holding. Apply the Probate and Administration Rules and the actual succession Court directions, rather than assuming ordinary civil motion procedure. Protect any minor or person lacking capacity.
