This guide explains Mohamoud Nuh Hussein Moghe v Khadija Nuh Hussein & another and the documents to prepare for an independent consultation.
The interim application did not stop distribution
The High Court refused to nullify the Kadhi’s proceedings at an interlocutory stage and dismissed the stay application with costs. It considered the administrators’ failure to distribute the estate and the rental-account concerns. This was an interim ruling, not the final appeal judgment. Its historical constitutional references should not be treated as the present framework.
Establish which estate and court files are involved
A lawyer for an undistributed Muslim estate needs the death record, complete court papers and all orders concerning administration and distribution. Bring any grant, confirmation, petition and subsequent application from every related file. An advocate should understand whether the present concern is implementation of an existing order, an account of income, identification of assets or a proposed challenge to a decision. These tasks require different evidence and procedural assessment.
Prepare a chronology showing when each file began, the decisions made and the steps taken afterward. List the parties and their stated capacities without assuming that one administrator speaks for every beneficiary. A lawyer should compare the actual orders and identify how the files relate. If you know of another proceeding concerning the same estate, include it at the start of the consultation rather than leave the adviser to discover it later.
Build an asset and income schedule
List each property said to belong to the estate with the records supporting that description. Include ownership documents, searches already obtained, tenancy agreements and any transfer instruments. An advocate needs to distinguish estate ownership from a beneficiary's individual property or a disputed asset. Mark uncertain entries openly so that verification can be planned. Possession of a house or collection of rent does not by itself explain every underlying ownership question.
For rental properties, record tenants, agreed rent, payment periods and the person receiving each payment. Preserve receipts and account statements in complete form. A lawyer can assess the evidence of income actually received, arrears alleged and expenses claimed. Separate vacant periods from unpaid rent and estimates from documented transactions. A clear schedule helps identify missing records without presenting an unverified total as a debt already established by a court.
Reconcile expenses and beneficiary payments
Bring invoices, maintenance records, rates receipts and other documents supporting spending from estate funds. Connect each expense with the relevant property and date. An advocate should see both income and expenditure when assessing an account. Keep personal spending separate from spending said to preserve an estate asset. Explain any cash transaction for which a receipt is unavailable and identify who can give direct evidence of it.
Prepare a separate list of amounts distributed to beneficiaries, including dates, recipients and acknowledgements. Distinguish a proposed payment from a completed transfer. A lawyer needs the actual balance and a record of disagreements about credits or deductions. If a family arrangement was discussed, preserve the entire correspondence and any signed document. An informal understanding may matter to the factual history without replacing a court order or establishing its legal effect automatically.

Describe the practical obstacle to completing distribution: an unresolved asset, missing signature, disputed beneficiary, unavailable account or another clearly identified problem. Attach the document showing it where possible. An advocate can then assess what application or further evidence may be needed. A general complaint that the estate has taken too long does not explain which step remains undone or who has the capacity to take that step.
Retain written requests for accounts and responses from the people managing the assets. Use factual descriptions of missing documents or unpaid amounts. A lawyer should assess an allegation before it appears in a pleading. Include explanations supplied by the other party and records that may resolve the discrepancy. Avoid public accusations about relatives or administrators while the adviser is still checking the transactions and the operative court directions.
Assess any request to pause an order
If a stay is proposed, provide the particular order, the appeal papers and evidence of the current event you want paused. Explain the consequence said to follow from implementation and the practical alternative proposed. An advocate needs a defined request tied to the live proceedings. Distinguish an application for temporary protection from a final determination about distribution, ownership or responsibility for estate income.
Ask a lawyer to review the proper forum, current time position, service requirements, evidence gaps and potential costs. The adviser should consider the present constitutional and statutory framework rather than apply an old ruling's wording without assessment.
