Decision analysed: In re Estate of Wolfgang Walter Wirth (Deceased) — [2025] KEHC 1523 (KLR) — 14 February 2025

Court: High Court at Mombasa

The dispute

A claimed foreign executor challenged a Kenyan intestate administration in an estate involving Kenyan land and a foreign will and grant. He relied on a later Kenyan resealing certificate. The administrators disputed the effect of the will on Kenyan assets, alleged a customary marriage and dependency, and opposed the claim. The filed chamber summons sought only temporary injunctions pending its own inter partes hearing, although affidavits and submissions asked for revocation.

What the Court decided

The High Court struck out the chamber summons because it contained no substantive revocation or annulment prayer and did not use the rule 44 Form 107 summons. It declined to consider the merits. The decision did not establish fraud, invalidate either grant, decide the will effect on Kenyan assets or finally determine spouse or dependant status. Dates for the intestate grant and confirmation differ within the source narrative and must be verified from the actual instruments.

What this decision does and does not establish

Section 76 and Probate rule 44 require the proper revocation application, including the grounds, identified grant and rule 44 affidavit/Form 14 requirements. Relief in an affidavit or submissions does not replace the prayer in the application. Authenticate a foreign will, grant, translation and any Kenyan resealing order, addressing the applicable succession and recognition law without assuming every foreign grant is automatically enforceable here.

Summons for Revocation of an Intestate Grant Where a Foreign Will Is Alleged

Use the actual succession cause and identify the grant precisely. Check section 76 and rule 44, the prescribed Form 107 summons and supporting Form 14 requirements, known administration status and service directions for all affected persons. This is substantive reconstructed wording, not a completed prescribed form. Interim preservation, revocation, new appointment and confirmation are distinct relief and stages. Proposed corrected reconstruction, not a successful source revocation application. The reported motion was struck out without merits consideration. Use the prescribed summons/Form 107 and required affidavit/Form 14, authenticate grant dates and serve all affected parties. Apply the Probate and Administration Rules and the actual succession Court directions, rather than assuming ordinary civil motion procedure. Protect any minor or person lacking capacity.

Administrator Replying Affidavit on a Foreign Will Kenyan Assets and Claimed Dependency

Complete the deponent identity, authority and actual personal-knowledge or identified-information basis. Index and authenticate genuine exhibits; missing exhibits are not supplied by this text. An affidavit is evidence, not a vehicle for new unpleaded relief or invented expert conclusions. Obtain any required leave for a further affidavit and complete a valid jurat before a competent authorised person. This specimen is unsworn. This is an evidential response to a properly pleaded summons. The source administrators opposed an interim-only chamber summons that was struck out without deciding the substantive rights. Apply the Probate and Administration Rules and the actual succession Court directions, rather than assuming ordinary civil motion procedure. Protect any minor or person lacking capacity.

Foreign Will Grant Resealing and Kenyan Administration Evidence Schedule

This is an evidential or accounting aid, not an originating process or independent proof. Give dates, authors or custodians, admissibility status, actual document pages and transparent calculations. Label missing and disputed items. Obtain the applicable leave or directions for supplementary evidence, serve it and prevent duplicate credits or recovery. Apply the Probate and Administration Rules and the actual succession Court directions, rather than assuming ordinary civil motion procedure. Protect any minor or person lacking capacity.

Succession Submissions on Proper Revocation Prayers and the Limits of Interim Relief

Identify pleaded issues, admitted evidence and genuine record pages. Follow directions on length, authorities, filing and service. Submissions do not introduce exhibits or cure missing substantive prayers. Distinguish what a party sought from what the Court ordered, and an unsuccessful historical position from the actual holding. Apply the Probate and Administration Rules and the actual succession Court directions, rather than assuming ordinary civil motion procedure. Protect any minor or person lacking capacity.
