Court: High Court at Mombasa
The dispute
A chemical importer engaged a clearing agent. After leakage and return of a container, Kshs 297,000 was paid for its replacement but the replacement was not supplied. The agent joined the shipping agency, which did not defend the third-party notice. The Small Claims Court entered judgment against the agent.
What the Court decided
The High Court rejected the argument that the Small Claims Court judgment was automatically invalid after sixty days. It allowed the appeal on the undefended third-party claim, substituted relief against the shipping agency and ordered it to pay the agent and importer their appeal and trial costs.

Read paragraphs 27–29 with the actual decree. A Small Claims Court appeal is confined to questions of law under section 38. Use its own rule 16 third-party process at trial; the judgment also discusses Civil Procedure Order 1 rules 17 and 19. Default requires lawful service and does not authorise an invented service return. Paragraph 10 has an inconsistent judgment year; the heading and operative order identify 28 October 2025. Do not reproduce the erroneous 2026 date.

Unreleased Replacement Container — Small Claims Statement of Claim
Use the prescribed Small Claims Court statement-of-claim form and rule 3, with genuine documents and lawful service. Check the monetary and territorial jurisdiction, related litigation, limitation, amounts and specific relief. This is substantive wording for the form, not an ordinary civil plaint. Substantive particulars for the prescribed claim form under Small Claims Court rule 3, not an ordinary Civil Procedure plaint. The public specimen supplies no signed contract or receipt.
Clearing Agent Response to Container Replacement Refund Claim
Complete the prescribed Small Claims Court response and serve it under rules 9 and 12. Give precise admissions, denials and the evidence for any counterclaim or set-off. Check the current summons and directions; this is substantive wording, not the prescribed form. Use the prescribed response under rules 9 and 12. This reproduces the agent position as a contested defence; the eventual appellate remedy was against the shipping agency.
Shipping Agency Indemnity — Small Claims Third Party Notice
Use the Small Claims Court prescribed third-party notice and rule 16 directions. Identify the contribution or indemnity basis, monetary scope and genuine documents. Serve all required material and prove actual service before seeking default consequences. Use Small Claims Court rule 16 and its prescribed third-party form. Do not automatically transplant an Order 1 notice from ordinary civil litigation. The source appeal discussed Orders 1 rules 17 and 19 on the admitted service record.
Container Replacement Liability — Memorandum of Appeal on Third Party Default
Identify the exact lower-court judgment or ruling, operative decree, parties, concise grounds and requested disposition. Use the procedure for this particular appellate court: an ELRC appeal and a High Court or ELC first appeal are not Court of Appeal proceedings. Check limitation, any necessary leave or extension, record, fees, service and directions. Filing an appeal is not an automatic stay. The source appeal succeeded on third-party liability, not the sixty-day nullity argument. Insert the genuine decree and check appeal limitation, directions, law-only scope and any stay application.
Undefended Shipping Indemnity — Appellant Written Submissions
Identify pleaded issues, admitted evidence and genuine record pages. Follow directions on length, authorities, filing and service. Submissions do not introduce exhibits or cure missing substantive prayers. Distinguish what a party sought from what the Court ordered, and an unsuccessful historical position from the actual holding.
