52. Liability for improper benefits
A person who receives a benefit the receipt of which would constitute an offence under section 39, 40 or 43 is liable, for the value of the benefit, to the following persons—(a)if the receipt constitutes an offence under section 39, to the agent’s principal;(b)if the receipt constitutes an offence under section 40, to the person advised; or(c)if the receipt constitutes an offence under section 43, to the persons beneficially entitled to the property.
