8. Penalty for non-compliance or false statement
(1)A member or widow who fails or neglects to comply with any of the requirements of section 7 of this Act shall for each default be liable, at the Asian Officers’ Family Pensions discretion of the Board, to pay to the Board a sum not exceeding forty shillings, which may be deducted from his or her salary or pension, as the case may be.(2)If a member or widow of a member at any time wilfully makes any false statement respecting any of the particulars required by this Act or any regulations made thereunder to be furnished, all or any part of the rights under the Fund of the member or the widow or any child of the member shall be liable to be forfeited at the discretion of the Board, and the Board may give directions for increasing the pension payable to any child of the member in consequence of forfeiture under this section of the rights of any child or the widow of the member, and such pension shall be increased accordingly.(3)Nothing in this section shall prejudice any right of the Board to recover any sum paid out of the Fund which would not have been paid but for such failure, neglect or false statement as aforesaid.
