23. Service under contract [Order 5, rule 23]
Without prejudice to the other rules in this Order, where—(a)leave to serve a summons or notice of a summons or other process has been allowed under rule 21 or 22; and(b)the contract provides that in the event of any suit in respect of the contract being begun, the process by which it is begun may be served on a defendant, or on such other person on his behalf as is specified in the contract, in such manner or at such place (whether in or outside Kenya) as is specified, then a summons or other process in that suit may be served as provided in the contract.
