12. Penalty for unsafe practices or procedures
(1)A person who, in the course of his professional practice, knowingly or negligently causes another to be infected with HIV through unsafe or unsanitary practices or procedures contrary to the provisions of this Part, or of any guidelines prescribed hereunder, commits an offence.(2)Notwithstanding the provisions of any other written law for the time being in force, a court may, in addition to any penalty imposed on a person convicted under subsection (1)—(a)in the case of an institution, order the revocation of any business permit or licence in respect thereof; or(b)in the case of a natural person, order the revocation of licence to practice such person's profession.
