6. Management of the Agency
(1)The management of the Agency shall vest in the Board which shall consist of—(a)a Chairperson appointed by the President upon the recommendation of the Public Service Commission through a competitive process;(b)the Principal Secretary in the Ministry for the time being responsible for matters relating to finance or a representative of the Principal Secretary;(c)the Principal Secretary in the Ministry for the time being responsible for matters relating to trade or a representative of the Principal Secretary;(d)the Principal Secretary in the Ministry for the time being responsible for matters relating to industrialisation or a representative of the Principal Secretary;(e)the Attorney-General or a representative of the Attorney-General;(f)three other members appointed competitively by the Cabinet Secretary; and(g)the Executive Director of the Agency who shall be the Secretary.(2)The Board shall ensure that all it appointments conform to the values and principles of the Constitution under Articles 27 and 32 and other relevant provisions of the Constitution.
