9C. Penalty for fraudulently procurement of registration of private mental health facility
(1)Where a person, procures or attempts to procure registration under section 9B by making, causing to be made, producing or causing to be produced any false or fraudulent representation or declaration either orally or in writing, that person commits an offence and shall be liable, upon conviction, if the person is a—(a)natural person, to a fine not exceeding four million shillings or to imprisonment for a term not exceeding ten years, or to both; or(b)body corporate, to a fine not exceeding ten million shillings.(2)In addition to the penalty imposed under subsection (1), the Board may lodge a complaint with the relevant professional body, to which that person is a member, for the institution of disciplinary proceedings against that person.
