59. Investigations by the Commission
(1)If the Commission becomes aware of circumstances where a contravention of Part III of this Act may have occurred (other than an alleged contravention that is the subject of proceedings before the Commission), the Commission may initiate investigation.(2)If, in the course of performing its functions under section 25, the Commission becomes aware of circumstances where a contravention of Part III of this Act may have occurred, the Commission may, with the consent of the Cabinet Secretary, investigate the matter.(3)If, in the course of dealing with a complaint or investigating a matter under subsection (1) or (2), the Commission becomes aware of circumstances where a contravention of Part III of this Act may have occurred (other than the contravention alleged in the complaint or the contravention being investigated), the Commission may investigate those circumstances.
