72. Illicit trafficking

Any person who—

(a)receives, possess, uses, transfers, transports, disposes or disperses a nuclear material or radiation source and which causes or is likely to cause death or serious injury to any person or damage to property or environment; or

(b)carries, sends, or moves nuclear material or radiation source, into or out of Kenya,

without lawful authority or contrary to the prescribed manner, commits an offence and is liable on conviction to an imprisonment for a term not exceeding ten years without an option of a fine.
