21. Delegation by Cabinet Secretary

(1)The Cabinet Secretary may delegate to any senior officer under the control, direction and supervision of the Cabinet Secretary, by name or office, any of the functions and powers imposed or conferred on the Cabinet Secretary under this Act except for the power to make rules under section 29.

(2)Any delegation under this section shall not prevent the Cabinet Secretary from personally exercising or performing such delegated function or power.

(3)A delegation made under subsection (1) may—

(a)be made subject to such conditions, limitations or restrictions as may be specified in the instrument of delegation; and

(b)be revoked or varied.
