18. Conditions for grant of rights

18. Conditions for grant of rights
(1)The conditions laid down in this section must be fulfilled with respect to both the applicant for plant breeder’s rights and the plant variety to which the application relates.(2)An applicant for plant breeders' rights must be the breeder, and the provisions of Part I of the Fourth Schedule shall have effect with regard to two or more persons who have independently bred, discovered and developed a plant variety.(3)A plant variety must conform to the rules set forth in Part II of the Fourth Schedule to this Act.
