39. Protection from personal liability
(1)No matter or thing done or omission by any member of the Board or by any member of staff or agent of the Board shall, if the matter, thing or omission was done in good faith for the purposes of performing the functions of the Board under this Act, render the person liable for any action, claim or demand.(2)Any expenses incurred or to be incurred by any person mentioned in subsection (1) in defending an action, claim or demand in any suit brought against that person in respect of any matter or thing or omission done or purported to be done by that person under this Act, or on the direction of the Board, shall be reimbursed or borne by the Board unless the matter, thing or omission was done in bad faith.
