35. Expert statement
(1)A prospectus or an offering memorandum shall not include a statement purporting to be made by an expert if the expert is or has been, engaged or interested in the formation or promotion of the real estate investment trust scheme or the offer of the REIT securities or in the management of the promoter or the REIT manager or is a person connected with the promoter, the trustee or the REIT manager.(2)A prospectus or an offering memorandum which includes or is based on a statement made by an expert shall not be issued unless—(a)the expert has given, and has not withdrawn, before the issue of the prospectus or offering memorandum, a written consent to the issue of the prospectus or offering memorandum and the inclusion of the statement in the form and context in which it is included; and(b)there is a statement in the prospectus or offering memorandum that the expert has given and has not withdrawn the consent.
