43. Trustee to be licensed by the Authority
(1)The trust deed for every real estate investment trust that applies for authorization as a scheme shall comply with the requirements of the First Schedule and provide for the appointment of a trustee to act as a trustee of a real estate investment trust.(2)A person who intends to act as a trustee in respect of—(a)a real estate investment trust scheme for which an authorization is required; or(b)any real estate investment trust,shall apply to the Authority to be licensed as such in accordance with regulation 125.
