45. Applicability
(1)This part shall be applicable to all helicopters except those specifically designed and used for agricultural, firefighting or external load-carrying purposes.(2)For helicopters which the application for the Type Certificate was submitted on or after 1 January 1985, except for those helicopters specified in regulation 45(4), the maximum noise levels of Regulation 48 shall apply.(3)For a derived version of a helicopter which the application for certification of the change in type design was submitted on or after 17 November 1988, except for those helicopters specified in regulation 45(4), the maximum noise levels under regulation 48(1) shall apply.(4)For all helicopters, including their derived versions, which the application for the Type Certificate was submitted on or after 21 March 2002, the maximum noise levels under regulation 48(1) shall apply(5)Certification of helicopters which are capable of carrying external loads or external equipment shall be made without such loads or equipment fitted.(6)An applicant under regulation 45(1) may alternatively elect to demonstrate compliance with Part XII instead of Part IX if the helicopter has a maximum certificated take-off mass of 3 175 kg or less.
