55. Applicability
(1)This part shall be applicable to all propeller-driven aeroplanes with a certificated take-off mass not exceeding 8 618 kg, except those aeroplanes specifically designed and used for aerobatic, agricultural or firefighting purposes and self-sustaining powered sailplanes.(2)For aeroplanes which the application for the Type Certificate was submitted on or after 17 November 1988, except for those aeroplanes specified under regulation 55(6), the maximum noise levels of 59 (a) shall apply.(3)For aeroplanes specified under regulation 55(2) where the application for the Type Certificate was submitted before 17 November 1993 and which fail to comply with the regulations under this part, the regulations under part VII shall apply.(4)For derived versions for which the application for certification of the change in type design was submitted on or after 17 November 1988, except for those derived versions specified under regulation (6), the maximum noise levels of 58(a) shall apply.(5)For derived versions specified under regulation 55(4) where the application for certification of the change in type design was submitted before 17 November 1993 and which fail to comply with the regulations under this part, the regulations under part VII shall apply.(6)For single-engined aeroplanes, except float planes and amphibians—(a)the maximum noise levels of 58 (b) shall apply to those aeroplanes, including their derived versions, for which the application for the Type Certificate was submitted on or after 4 November 1999;(b)the maximum noise levels of 58 (b) shall apply to those derived versions of aeroplanes for which the application for the Type Certificate was submitted before 4 November 1999 and for which the application for certification of the change in type design was submitted on or after 4 November 199, except for those derived versions described under regulation 55(6)(b) where the application for certification of the change in type design was submitted before 4 November 2004 and which exceed the maximum noise levels of 59 (b), in which case the maximum noise levels of 59(a) shall apply.
