IN EXERCISE of the powers conferred by section 42(1) of the Competition Act, 2010, the Competition Authority of Kenya excludes the merger from the provisions of Part IV of the Act due to the following reasons—(a)the merger will not affect competition negatively; and (b)the acquirer had no turnover while the target's was KES 88,114,393 for the preceeding year, 2015. Therefore the turnover of KES 88,114,393 is below the required threshold for mandatory notification as provided for in the Merger Threshold Guidelines.
