40. Application for certificate of fitness or leave to appeal in criminal matters
(1)In a criminal matter—(a)where an appeal lies on certification by the superior court that the case is a fit case of appeal, application for such a certificate may be made informally and ex parte; and(b)where an appeal lies with the leave of the Court, application for such leave shall be made in the manner laid down in rules 44 and 45.(2)An application under this rule shall be made without unreasonable delay but need not be made before notice of appeal is lodged.
