This article analyses Sanlam General Insurance Co Ltd v Barrow & another, decided by Garsen High Court.
A disputed payment account was sent for full hearing
Garsen High Court allowed the insurer’s appeal from a Hola proceeding after its defence had been struck out. It set aside the ruling and consequential orders, dismissed the strikeout application and remitted the suit for hearing before a different magistrate. Appeal costs went to the insurer. The defence asserted that the underlying awards had been paid; the judgment did not finally establish full payment or determine a recoverable balance. This is a restored opportunity to contest the account, rather than a final discharge of the debt.
Start with the exact demand you have received
A judgment already paid balance demand lawyer needs the current letter, application or summons and the judgment said to support it. An advocate should understand whether the demand concerns principal, interest, costs or an alleged unpaid instalment. Identify the recipient and sender of each payment before describing the judgment as settled. A transfer to an intermediary may require further explanation of how it was credited.
Bring the original demand and any later revised version. Preserve attachments showing the calculation. Explain what you accept and what you dispute instead of rejecting the whole account without identifying the error. The adviser can compare the actual request with the court record and assess the issue requiring a response.
Build a payment schedule that another person can check
List each transfer by date, amount, payer, recipient and stated purpose. Attach the bank confirmation or receipt that supports the entry. A lawyer needs a schedule tied to evidence rather than a total copied from an insurer’s email. Explain reversed payments, unsuccessful transfers and duplicated transaction references so they are not counted as money received.
If the payment covered several judgments, provide the allocation instructions. An advocate should be able to trace the sum credited to each file. Where allocation is unclear, mark that uncertainty explicitly. Do not assume that a single payment extinguished every related case merely because the claimant or advocate was involved in all of them.
Separate the underlying claim from the insurer proceeding
Supply pleadings and orders from both files where there is an original accident claim and a later insurance claim. Identify the parties in each proceeding. A lawyer needs to distinguish the liability established against a defendant from the separate relief requested against an insurer. Use the actual case references in correspondence so documents are not attached to the wrong account.
Include any settlement, acknowledgement or discharge relied upon. Explain who signed it and which obligations it addresses. The advocate can assess its wording alongside the payment record. A document acknowledging receipt of one amount should not automatically be described as an agreement releasing every later interest or costs item.

Bring the defence actually filed, supporting documents and any application seeking to remove it. Identify the hearing date and current directions. An advocate needs to examine what the pleading says, not just the explanation now offered in consultation. Evidence of payment should be connected to the particular allegation you want to contest.
If your defence has already been struck out, supply the ruling and subsequent orders. Explain whether an appeal, review or execution application is pending. The adviser can assess the available procedural position without assuming that another insurer’s successful appeal automatically restores your own pleading or suspends enforcement in your file.
Reconcile the account before asking for a final outcome
Provide the decree, costs certificate, interest calculation and records of amounts credited. Keep principal and additional charges in separate columns. A lawyer can then identify whether the disagreement concerns receipt of money, allocation or the calculation of the claimed remainder. Retain the other side’s figures as well as your own.
For consultation, send the demand, court documents, payment schedule and supporting receipts together. State the next hearing or enforcement date. A lawyer and advocate can review the matter connected to Hola Law Courts and the proper forum for any next step. The Sanlam judgment supports careful distinction between a potentially arguable payment defence and proof of complete satisfaction; it does not confirm the balance in a different file or promise that an appeal will succeed.
