This guide explains Ogoti v Safaricom & another and the documents to prepare for an independent consultation.
The evidential appeal left the privacy suit pending
The underlying Kabarnet claim concerned disclosure of personal information. Kabarnet High Court dismissed an appeal challenging production of a court order by a liaison officer and awarded costs to the respondents. The order’s authenticity was not disputed, it had been disclosed before trial and it was relevant to the information-release dispute. The court also refused to move the trial to another magistrate without a demonstrated basis. It did not finally determine whether the original disclosure was unlawful or award compensation for a privacy breach.
Identify precisely which information was released
A personal data disclosure lawyer needs a clear description of the information, the organisation holding it and the person or body that received it. Provide documents showing the alleged release and explain how you learned of it. An advocate should be able to distinguish a suspicion of disclosure from a record establishing what was actually supplied.
Keep correspondence, account records and relevant messages in their original form. Redact unrelated material from a separate consultation copy where appropriate while retaining the original securely. Identify the connection between the disclosure and the harm you say followed. A broad complaint that your privacy was invaded may conceal several different events requiring separate factual assessment.
Obtain the order relied on to justify disclosure
If the organisation says it acted under a court order, ask your adviser to examine the complete order and relevant proceedings. Include the file number, date and wording available to you. A screenshot of a paragraph may omit qualifications or later directions. The advocate needs the document itself before assessing its scope and relation to the released material.
State whether you dispute authenticity, interpretation, relevance or compliance with the order. These are different questions. Keep communications showing the organisation’s explanation and the documents it relies on. The admission of the order in Ogoti did not decide every possible objection to a different disclosure or establish that all information supplied under any order is necessarily justified.
Review disclosure during preparation for trial
Bring the filed document lists, witness statements and pre-trial directions. Mark when you first received the disputed document and any objection already raised. A lawyer needs the procedural record alongside the document. Explain whether the question concerns introducing it as evidence, challenging its contents or examining the conduct said to be authorised by it.
Do not assume that failure to call a particular person automatically excludes every document. An advocate must assess the nature of the record and the applicable evidential requirements. For preparation, identify what you want to question and why the available witness may or may not address it. The practical aim is a focused explanation of the actual objection.

When a document is admitted, retain the ruling and any directions concerning its use. Tell the advocate which factual proposition the opposing party says it proves. The document’s presence in the evidence is a separate matter from the conclusion the court will eventually draw from the entire record. Your consultation should make clear which point remains in dispute.
Supply the evidence you consider inconsistent with the proposed interpretation. Label your explanation separately from quotations from the order. An advocate can assess the document’s relevance in context and prepare questions supported by the file. An evidential ruling should not be presented as though it automatically disposes of the underlying privacy claim.
Explain any request to change the judicial officer
If you seek a different magistrate, provide the conduct or ruling relied on and the complete record of the relevant hearing. Identify the specific concern and supporting material. Dissatisfaction with an evidential ruling needs careful examination before it is used as the basis for a separate procedural request. An advocate should assess the actual reasons you propose.
Keep earlier applications and responses with their outcomes. Do not convert an unsuccessful objection into an allegation of bias without an evidential basis. The lawyer needs a factual account of the proceedings, including material that may explain the court’s approach. Ogoti records a refused transfer request in its particular circumstances; it does not determine the suitability of an officer in another file.
Prepare a focused Kabarnet consultation file
Send the alleged disclosure record, the relied-on order, the evidence lists and the relevant rulings together. State whether you need advice on the substantive claim, an evidential objection or an existing appeal. Include upcoming dates and explain your role in the proceedings. The adviser can assess the next step using the actual record.
A lawyer and advocate can examine what remains undecided and the documents needed to address it. This article uses an appeal about evidence as a practical example. It does not describe a final finding against the organisations in the underlying claim or promise compensation for personal information disclosed in different circumstances.
