This article analyses Republic v Ali & 2 others, decided by Kahawa Law Courts.
A case-to-answer ruling is a stage of trial
Republic v Ali concerned the Dusit attack prosecution. After hearing 55 prosecution witnesses, Kahawa Law Courts found a prima facie case against the remaining second and third accused and required their defences. The first accused's plea bargain and conviction were a separate part of the history.
This ruling was not a final finding of guilt against the two accused placed on their defences. It did not transfer the ultimate prosecution burden to them. The narrow issue analysed here is preparation for the defence stage after a case-to-answer ruling, rather than a prediction of the verdict or sentence.
Identify which accused and counts the ruling covers
A terrorism defence lawyer needs the current charge sheet and the complete ruling. Where several people are charged, identify the person seeking advice and every relevant count. A result concerning one accused should not be presented as the outcome for all co-accused. Keep an earlier plea agreement separate from the record of a contested trial.
Provide any amended charge sheet and the order recording the amendment. Numbering can change during proceedings, making a short description of the accused or offence unreliable. The reviewing advocate should be able to compare the charges, the evidence stage and the order using the documents in the actual file.
Assemble the prosecution record
Supply the proceedings and exhibit list available to you. Mark any transcript pages or exhibits still missing. A review of whether there is a case to answer depends on the record, not simply the number of witnesses called. Several witnesses may address the same event while a different issue turns on one document.
Prepare a factual index connecting each contested issue to the relevant testimony or exhibit. Keep your account of what happened separate from a quotation or summary of the evidence recorded in court. That distinction enables the advocate to assess the issue without assuming that a client's recollection is already part of the trial record.
Record the defence directions accurately
Provide the order setting the next date and recording the explanation of defence rights. Identify any direction about witnesses or documents. Do not infer your options from the way another accused conducted a defence in a different case. The adviser needs the current directions and the explanation actually recorded in your proceedings.
Discuss any concern about interpretation or understanding with the advocate, supplying the available record. A public article cannot choose whether an accused should testify or what evidence should be called. Those decisions require confidential consideration of the charges, prosecution evidence and the person's instructions.

Keep relevant communications, location records and documents in their original form. Explain where they came from and which point you believe they address. Avoid editing a message or combining extracts in a way that changes context. An advocate should receive enough information to assess relevance and authenticity without treating every proposed item as admissible evidence.
Identify potential witnesses and the subject of their first-hand knowledge through a private consultation. Do not publish personal details or coach an account to match a desired outcome. A factual chronology should distinguish what you observed, what somebody told you and what a document records.
Prepare a focused Kahawa enquiry
State whether the immediate concern is understanding the case-to-answer ruling, preparing for a scheduled defence hearing or obtaining missing proceedings. Include the actual hearing date and file reference. Supply the charge sheet, ruling and latest direction before asking for a view on a procedural step.
Ali demonstrates the distinction between a prima facie case and a final conviction. The cited ruling establishes the stage reached on 21 January 2025, not the later result of every accused's trial. A lawyer or advocate reviewing a different Kahawa matter must consider its own evidence and current orders before advising on the defence stage.
