In Alimahadu v Ombuya, Kakamega ELC upheld the registered proprietor’s possession claim despite the occupiers’ purchase agreements and developments. The decisive gap concerned the person from whom they bought.
The buyers relied on agreements with someone else
The dispute concerned Kakamega/Lugari/67. Occupiers said they purchased portions from Mary Mbaisi and developed them. The plaintiff’s proprietorship was confirmed by an earlier Court of Appeal judgment. Buyers who testified acknowledged that they had not conducted registry searches before transacting.
The agreements could not compel this proprietor to transfer
The defendants did not seek nullification of the plaintiff’s title. They sought to compel him to transfer portions under agreements to which he was not a party. The court rejected that counterclaim and treated their occupation without his permission as trespass.
A Kakamega property advocate reviewing a purchase should connect the seller to the current register and any claimed authority. If the seller is a representative, obtain the actual instrument conferring power. If another person owns the land, explain how that person’s rights would lawfully be affected by the proposed sale.
An agreement records obligations between its parties; it does not necessarily bind every person with an interest in the property. Before paying for construction, identify who must execute completion documents and whether the title being promised can actually be delivered. A site visit and a convincing local account cannot answer all those questions.
Development expenditure did not establish ownership
Defence witnesses described homes and other improvements. Those investments did not supply an enforceable right against the plaintiff on the pleaded case.
Keep receipts and evidence of improvements, but separate them from the title inquiry. An advocate may need to consider a claim against a seller or another responsible party; that is different from assuming expenditure itself defeats the registered owner’s possession claim. This judgment did not award buyers a construction refund.
If occupation began under a purchase arrangement, provide the agreement, payment records and all communications about completion. Explain when you learned of the competing claim and what you did then. Those facts can affect the assessment of parties, remedies and evidence, even where they do not establish ownership.
The outcome required vacant possession
The counterclaim was dismissed. The defendants were ordered to vacate within ninety days from delivery of the judgment, with an eviction order to issue on default. The plaintiff received the costs of the suit.
That disposition is different from a finding that the buyers’ transactions were criminal fraud. The court resolved the civil possession claim and the counterclaim before it. Describe the result accurately when seeking advice about recovery of payments or challenging another person’s conduct.
A person affected by such a decree should bring the complete judgment, decree and any stay application to the advocate. The relevant timetable must be checked against the actual order and subsequent proceedings. This article does not authorise private demolition or removal of occupiers without the applicable process.

- A current official search and relevant register history.
- The seller’s identity and legal authority.
- Existing judgments or pending disputes affecting the parcel.
- The agreement’s completion obligations.
- Payment records and site-possession correspondence.
- Survey identification of the portion being sold.
Reviewing these documents before construction can reveal a gap between what the seller promises and what the register supports. Where a portion is to be excised, the advocate should also explain the required subdivision and transfer steps. Do not treat physical boundaries shown by the seller as completed registration.
