A Kericho property advocate or land lawyer reviewing an auction purchase should obtain the earlier execution proceedings and every later challenge. The KUDHEIHA v Management of Tea Hotel ruling concerned objections to a land petition arising from a labour-case auction. The objections failed, but the ruling did not finally restore the purchasers’ title or award their claimed damages.

The auction followed a labour judgment

The dispute involved Kericho Municipality Block 4/295. The petitioners described purchase at a public auction in execution of the decree in Kericho ELRC Cause 10 of 2016 and a title issued in December 2019. Proceeds had been shared among former workers.

The labour court later set aside the sale and directed cancellation of entries. The September 2025 ruling recorded pending appeals from that decision. The land petition sought property-right declarations, relief concerning interference and monetary remedies.

Those prayers were claims awaiting determination, not awards already obtained. The record also contained a contempt application. This particular ruling addressed the preliminary objection rather than deciding whether anyone should be imprisoned for contempt.

The related-case objection required evidence

At paragraphs 83–94, the court examined whether the petition was sub judice because of the earlier labour proceedings. The objectors relied on the relationship between the matters, while the petitioners said the earlier case had been determined.

The judge found that the pleadings from the earlier case had not been placed before the court. Comparing the issues required examination of facts, which defeated the attempt to decide the point through this preliminary objection. The ruling did not declare that related proceedings can never affect a land petition.

Someone searching for an advocate for an auction property dispute in Kericho should supply the earlier pleadings, decree, sale orders and later applications. A summary stating that another case concerned the same hotel is inadequate to show whether the parties, issues and relief overlap.

The land court could hear the pleaded property issues

Paragraphs 95–117 addressed jurisdiction and the argument that the matter remained an employment dispute. The court examined the petition’s requests concerning title, possession and property rights and held that these fell within its environment and land jurisdiction.

The history in the labour court did not, on its own, remove that jurisdiction. Equally, this was not an ELC appellate judgment reversing the labour court’s auction decision. The court recorded the pending appeals and reserved the merits of the land relief for determination.

The union’s standing also remained for hearing

The objectors challenged the union’s interest and the position of the affiant. The union explained its connection through proceeds distributed to former employees and disputed the characterisation of its secretary’s role.

At paragraphs 118–122, the judge held that the standing issue should be canvassed at the petition hearing in the circumstances. This should not be recast as a final decision that every claimant had proved ownership or authority to recover the property.

The order dismissed the objection with costs

Paragraph 123 dismissed the February 2025 preliminary objection with costs. There was no new final title-registration order, rent award or damages sum in this ruling. Allegations about interference and violation of rights remained distinct from established final findings.

The source uses different respondent numbering when discussing the petition and subsequent application. This article follows the issues and operative order without manufacturing a single corrected party list. A live review must use the complete court file to identify who is subject to each order.

Review the purchase and litigation chains together

  • The decree and authority for the auction.
  • Auction notices, payment records and transfer instruments.
  • The cancellation decision and extracted orders.
  • Appeals, stays and status-quo directions.
  • The petition, responses and contempt application.

These documents help an advocate separate the acquisition history from the current procedural position. Possessing a historical title or defeating an objection does not alone establish what dealings are permitted today. Later orders must be checked before assessing possession, leasing or enforcement.
