In Muchiri v Kariuki, Kerugoya ELC dismissed an appeal after examining the succession account, the pleadings and the evidence of an asserted beneficial right. The case shows why occupation must be linked to a specific legal basis.
The registered title followed a confirmed grant
The dispute concerned Kabare/Ngiroche/1115. The proprietor’s title followed an unchallenged confirmed succession grant. The appellants relied on occupation and family entitlement; a trust argument was advanced in appellate submissions without being pleaded below.
The appeal could not substitute a new trust claim
The ELC held that the trust issue had not been pleaded or tried. It also found no evidence establishing the required intention to create a trust. Occupation alone did not supply that missing foundation.
A Kerugoya land advocate should identify the beneficial interest asserted at the start of the case. Explain who allegedly held for whom, how the arrangement arose and what conduct or instrument supports it. A reference to family ownership needs a factual account capable of answering those questions.
If the claim is revised, assess the necessary procedural steps and evidence rather than add a trust label in final submissions. The opposing party must have an opportunity to respond. The court’s role is to determine the pleaded case, not construct a different one from a general family grievance.
The succession outcome was part of the title history
The court considered the appellants’ knowledge of the grant and distribution. Their account did not establish a right to the share they sought from the respondent’s registered property.
For a family dispute involving inherited land, obtain the petition, confirmed grant and distribution documents. Identify whether the complaint concerns the succession process, an independent trust or the validity of later registration. Those are related questions but can require different legal routes and parties.
Do not assume that every person related to the deceased was allocated this particular parcel. Compare the claimed entitlement with the estate record and any other allocation. An advocate needs the complete account to assess whether the land proceedings can address the actual grievance.
Permission and prolonged use needed a coherent account
The evidence included an admission of permitted occupation and an agreement to vacate. The ELC accepted the proprietor’s rights and found the appellants had not established a legal or equitable basis for remaining.
Where occupation began with a relative’s permission, preserve the terms and later communications. Explain whether the occupier says another right subsequently arose and the facts supporting that assertion. Counting years without explaining permission may misdescribe the relevant legal position.
Likewise, improvements should be documented but should not be treated as automatic ownership. Identify who authorised the work and whether any arrangement addressed reimbursement or continued residence. A property advocate can assess the available claim without conflating expenditure with title.

The ELC dismissed the appeal with costs to the respondent, leaving the trial possession outcome undisturbed. The judgment did not recognise the asserted trust or award the appellants a share.
For someone affected by the decree, review the actual orders and any later stay before deciding on occupation or enforcement steps. This article does not provide a timetable absent from the appellate disposition or authorise private action in another dispute.
Preparing a Kerugoya family-possession file
- The title and complete transmission history.
- The confirmed grant and distribution record.
- Trial pleadings and admitted evidence.
- The alleged trust arrangement and supporting witnesses.
- Permission and occupation correspondence.
- Records of improvements and any agreement about them.
The file should show the connection between family history and the right asserted over this parcel. That connection, rather than residence alone, allows an advocate to assess whether a defence or affirmative claim can be supported.
