This article analyses Said & another v Mohamed & 2 others, decided by Malindi Court of Appeal — Sub-registry.
The second appeal did not overturn the distribution
The Court of Appeal dismissed the challenge with respondents' costs. The dispute concerned houses without land and identification of Amer Mohamed Said's interest in his father's earlier estate before distribution to Amer's heirs. The court also rejected the fair-hearing complaints on the record. Its heading identifies the Court of Appeal at Malindi, while delivery was signed at Mombasa. The judgment does not establish that ownership of a coastal building necessarily includes the underlying land.
Identify the building interest and the land separately
A Kilifi Kadhi inheritance advocate needs documents explaining the property interest held by the deceased. Provide house purchase material, agreements with the landowner and any title documents. Identify whether you claim the building, the land, a share of either or rental income. Do not use a land parcel number as a substitute for proof that the deceased owned the building.
Prepare a physical description of the house, rooms, shops and later additions. Supply plans or clear sketches where available. The lawyer needs to distinguish the original property from improvements and to understand the arrangement under which the building stands. Describing everything as family land may conceal the precise interest requiring distribution.
Trace interests through more than one deceased person
Make a family chronology showing deaths, relationships and earlier distributions. If the current deceased inherited from another estate, provide the documents establishing that share. Explain whether the earlier estate remains undistributed and identify the relevant files. The advocate must understand how the present claim derives from the earlier property.
Keep the two estates' assets and beneficiaries separate in your records. An interest passing through an earlier estate should not be treated as ownership of its entire property. Ask the lawyer to examine the link between the interests, the necessary parties and the procedure supported by the current record.
Document alterations and independent improvements
List extensions, additional shops and renovations with approximate dates, persons responsible and proof of payment. Identify any agreement about who would own an addition or receive its income. Keep the evidence of construction expenditure separate from evidence of inheritance entitlement.
Do not assume that paying for improvements automatically gives ownership of every inherited asset. Likewise, do not assume that every later structure must be distributed as part of an earlier estate. An advocate can assess the particular documents and distinguish estate property from independently claimed interests. Supply both sides' accounts if the improvement history is contested.

Provide pleadings, witness statements, documents produced and proceedings. If you allege that you could not challenge evidence, identify the particular document or witness and the recorded objection. Include any application to recall witnesses and the ruling. A general dissatisfaction with the hearing is less useful than the relevant record.
This appeal examined participation and opportunities to cross-examine. It should not be described as a finding that all procedural complaints in inheritance cases fail. Your adviser must assess the actual alleged prejudice and how it was raised, together with the stage and scope of any proposed appeal.
Check the complete chain of orders before acting
Bring the Kilifi Kadhi decision, the Malindi High Court judgment and the appellate orders. Identify any directions for a rehearing and the decision made afterward. An older order cannot be read in isolation from the later proceedings. Obtain the current file position before proposing transfer, rent collection or enforcement.
For an enquiry, explain your relationship to the deceased, the building interest disputed and who currently occupies or receives rent from it. Attach a short family chronology and key property documents. Ask for review of the inherited share, the distinction between building and land and the appropriate procedural route. This analysis concerns the identified appeal connected to Kilifi Kadhi's Court and does not promise any inheritance percentage for another family.
