If you need help from a kilifi secured land auction and repeated injunction lawyer or advocate for a matter connected to Malindi Environment and Land Court, start with the actual orders and documents. This article analyses Menza & another v Micro Enterprises Support Programme Trust & 2 others, decided by Malindi Environment and Land Court.

The repeated injunction request was dismissed

Malindi ELC upheld a preliminary objection and dismissed the application for an injunction pending appeal with respondents' costs. The dispute concerned Roka/Uyombo/33 and secured loan recovery. The court found abuse of process in the sequence of earlier litigation and a new Kilifi suit seeking similar protection. The ruling did not grant an injunction stopping the sale. It should not be described as a new trial deciding every aspect of the parties' loan account.

Bring every earlier application to the adviser

A Kilifi land auction advocate needs the complete procedural history. Supply the original plaint, injunction application and orders, together with any reinstatement application. Add appeal documents and decisions about stay. Identify which file each document belongs to rather than presenting all court papers as one case.

Prepare a chronology of filing, hearings, dismissals and attempted withdrawals. Include applications that failed as well as those that succeeded. A lawyer assessing urgent protection must know whether another court has already considered the same relief and whether connected proceedings remain pending. Omitting an inconvenient order can prevent a reliable assessment of the next step.

Separate the debt dispute from the request to preserve land

Bring the charge documents, loan agreement, account statements and repayment evidence. Explain what part of the debt you dispute and why. Identify any notices and the proposed sale date. An advocate can examine the commercial documents while also evaluating the procedural position of an injunction application.

Do not assume that a disagreement about the balance automatically stops enforcement. Likewise, failure to obtain interim protection does not answer every possible question about the loan. Write the requested remedies separately: temporary restraint, account review, relief against an order or another substantive claim. The adviser can then assess which route fits the actual record.

Check what happened to the previous proceedings

A notice saying that a case or appeal is withdrawn needs to be read with the court record. Provide the notice and any order adopting or recording it. Tell the lawyer whether a hearing or decision occurred after the notice. Avoid assuming that filing a notice removed every obstacle to a fresh suit.

If the earlier appeal was challenged as late or defective, include that ruling. Ask the advocate to examine the available procedure within the existing litigation before starting another case. A new case number is not proof that the legal issue is new. The relationship between the parties, land and relief matters.

Preserve the sale documents and identify current events

Keep auction advertisements, notices, correspondence and documents concerning any completed transfer. State clearly whether you are seeking to stop a future sale or challenge steps already taken. An article about an injunction application cannot confirm whether an auction later occurred or whether registration has changed.

Obtain a current title search and explain any differences from older searches. If possession is also disputed, provide the relevant orders separately. A lawyer needs to understand the current event requiring attention, not merely the historical reason you first went to court. Highlight the earliest scheduled date in your enquiry.

Prepare a focused consultation request

State your role as borrower, owner, purchaser or another affected person. Identify the parcel, lender and court files. Attach the operative orders and a short account of payments. Explain the specific outcome you want and whether another advocate remains on record. These details make it easier to assess both the documents and the procedural constraints.

Ask for advice on the appropriate application, its evidential basis and the effect of previous decisions. A refusal of repeated interim relief in this case is not a blanket statement that every borrower lacks a remedy. Your own documents and current orders require an individual review. This analysis concerns Malindi ELC proceedings arising from Kilifi litigation and does not promise that filing elsewhere will produce an injunction.
