In Obura v County Government of Kisumu & 3 others, the Kisumu ELC rejected the county’s preliminary objection but also refused the claimant’s application to restrain activity on the land. The ruling illustrates two different evidential tests.
The alleged road-construction arrangement
Killion Obura sued as representative of his father’s estate concerning Kisumu/Kasule/488. He alleged that the land had belonged to his father, who allowed murram extraction for road construction on the understanding that the property would be returned.
He said a 2022 search disclosed registration in the name of the county’s predecessor. He pleaded fraud and challenged the legality of that registration. The defendants disputed his asserted ownership and the excavation arrangement.
These were the claimant’s allegations, not final judicial findings of land theft or construction fraud. The July 2025 decision dealt with preliminary objections and an interim application; it did not determine the ownership suit after trial.
Why the limitation objection failed at that stage
The county argued that the land-recovery claim was brought far beyond the ordinary limitation period. The plaintiff pleaded recent discovery of the allegedly fraudulent registration.
At paragraph 13, the court found that whether fraud occurred and when it was discovered required evidence at trial. Those disputed facts could not be resolved as a pure preliminary objection. The objection based on time bar therefore failed.
That ruling did not establish that the claimant had proved fraud, nor did it finally establish the discovery date. A Kisumu land advocate must still assemble evidence of what was learned, when it was learned and the registration history relied upon.
The jurisdiction objection also failed
The county argued that the property fell within the lower court’s monetary jurisdiction. Paragraph 14 explained why the possibility of a lower court having jurisdiction did not itself oust the ELC’s jurisdiction in this suit. The asserted valuation was also unsupported by evidence.
The conclusion belongs to this objection and record. It does not supply a universal filing instruction or remove the need to check the appropriate forum and applicable limits for another claim.
Why the claimant still lost the injunction application
The interim application sought to restrain occupation, construction and other interference pending suit. The court required a prima facie case supporting the asserted right that needed protection.
At paragraph 16, the judge found no evidence proving the claimant’s assertion that his father owned the property. The county produced the adjudication demarcation register recording its predecessor as owner, while the official search also reflected that registration.
The application did not supply evidence demonstrating the alleged fraud in that adjudication or registration. The court therefore found the first injunction threshold unmet and did not proceed to decide the remaining conditions.
The two results are consistent
A preliminary objection assumes the pleaded factual position for the relevant legal question and cannot resolve contested evidence. An injunction application requires the applicant to place an adequate interim evidential case before the court.
The claimant could therefore keep his suit alive while failing to secure immediate protection. Describing this ruling only as “the fraud case won” would conceal the refusal of the urgent remedy; describing it as a final ownership loss would go beyond what was decided.

Paragraph 17 dismissed both the county’s preliminary objection and the plaintiff’s injunction application. Costs were to be in the cause. There was no final declaration of ownership, cancellation order or damages award.
Building the evidence for an interim property application
- Documents establishing the estate’s asserted land interest.
- The adjudication record and complete registration history.
- Evidence supporting the alleged limited-purpose permission.
- A documented discovery chronology.
- Evidence locating current works and the threatened interference.
Frequently asked questions
Did rejection of the objection prove the fraud allegation?
No. The disputed fraud and discovery questions remained for trial.
Did the court grant an injunction against construction?
No. The claimant did not establish the required prima facie case.
Was this a final judgment cancelling the county’s title?
No. It was a procedural ruling on the objection and interim application.
Before requesting urgent relief at Kisumu ELC
A property advocate should test the documents supporting the threatened right before drafting the application. Allegations sufficient to require a trial may still be insufficient to obtain the immediate order the client needs.
