If you need help from a kwale consent debt decree arrest and stay application lawyer or advocate for a matter connected to Kwale High Court, start with the actual orders and documents. This article analyses Mwakuwema v Matano, decided by Kwale High Court.

The application failed while the appeal remained pending

The debtor sought protection against execution of a consent decree originating in Kwale Magistrates Court. Earlier temporary protection required payment and a settlement proposal before the trial court. The record showed noncompliance and failure to file submissions despite further time. Kwale High Court dismissed the application with costs and gave directions for the appeal record. It did not finally decide the underlying appeal or establish coercion in signing the consent. The publication’s county label differs from the signed Kwale court heading; the heading identifies the deciding court used here.

Bring the consent and the decree together

A Kwale consent debt decree lawyer needs the agreement recorded by the parties, the resulting order and the decree. Explain who signed, who represented you and which sums you accepted or disputed. An advocate should see the actual wording before assessing a proposed challenge. A later disagreement about payment does not by itself explain the circumstances in which consent was given.

If you say pressure affected your decision, provide the communications and chronology supporting that account. Identify any person with direct knowledge. Separate the facts you can establish from your interpretation of them. Your lawyer needs both the explanation and the documents before assessing which procedural route may be appropriate.

Reconcile every payment against the current balance

Prepare a dated account showing amounts paid, credits accepted and the balance disputed. Attach receipts, transfer records and acknowledgments. Explain any difference between your schedule and the creditor’s calculation. An advocate should review the position at the time of each relevant order, not only the amount stated when the claim was filed.

Include settlement proposals and responses. Identify whether a proposal was accepted, recorded as a consent or left unanswered. A request to pay by instalments should not be described as an existing court arrangement unless the record supports it. Provide the order creating any current payment condition and evidence of your compliance.

Explain the execution step requiring attention

Supply the notice to show cause, warrants and any service record. State when you learned of them and what appearance is presently listed. Do not assume the appeal itself prevents execution. Your lawyer needs to identify the latest effective order and the immediate step requiring a response.

Explain your financial circumstances with documents relevant to the request you intend to make. If a previous condition could not be met, record what happened and what application, if any, was made to address it. An advocate should assess the actual procedural history before advising on protection or further proposals to the court.

Keep a record of filings and directions

Bring the application, response, affidavits, submissions and proof of filing. Identify any document that was prepared but never lodged. Preserve acknowledgments and notices. The adviser needs to know what material was actually before the court when a decision was made, rather than assume that drafting a document made it part of the record.

List the directions issued and the steps taken to comply. If an extension was granted, include its terms and the document filed under it. A careful compliance schedule helps the lawyer assess both the present position and the explanation needed for any outstanding procedural step.

Define the outcome sought in consultation

Explain whether you seek assessment of a consent challenge, a stay application or a settlement arrangement. Send the consent, decree, payment account, execution papers and latest orders together. Include any forthcoming appearance. The advocate should receive a concise explanation of the disputed obligation and your immediate concern.

Ask for review of the appropriate route and the evidence needed for it. Mwakuwema shows an unsuccessful interlocutory application with the substantive appeal still subject to directions. It does not determine your debt, promise protection from execution or establish that an allegation of coercion will succeed without examination of the particular record.
