This article analyses In re Estate of Nrangu (Deceased), decided by Kwale Kadhis Court.
The final order differed from the equal-sharing proposal
The estate comprised Kombani SS/1387. Most of the surviving children proposed equal shares, while a son requested distribution under Islamic succession principles and raised descendants of a predeceased sibling. Kwale Kadhi ordered each of two sons to receive 2/11 and each of seven daughters 1/11. Three administrators or trustees were appointed, with leave for transmission and sale or transfer. The operative order did not separately allocate a share to the predeceased sibling’s children. A family proposal must therefore be distinguished from the court’s actual allocation.
Record precisely what the heirs agreed and disputed
An heirs disagree about land shares lawyer needs the written proposals and the position of each person affected. Explain whether an agreement was signed, discussed informally or merely suggested by one relative. An advocate should not describe a proposed equal division as unanimous when the record contains a different request from another heir.
Bring meeting notes, signed documents and correspondence in their existing form. Identify who attended and who was absent. If someone now withdraws support, state when that happened and why. The adviser needs to assess the legal significance of the actual communications rather than rely on a general claim that the family already settled everything.
Separate identifying heirs from calculating their interests
Prepare a family tree supported by available relationship and death records. Indicate who survived the deceased and who died earlier or later. These distinctions may affect the analysis. Do not combine descendants of a predeceased child with the estate of a child who survived the original deceased without explaining the chronology.
Ask the advocate to assess the applicable rules and the evidence for the proposed beneficiaries. If a relative’s entitlement is disputed, identify the exact issue. A family tree is useful preparation, but it does not itself establish a legal share. Avoid presenting your preferred calculation as an existing court finding.
Compare every proposed division with the current title
Obtain the current search and explain whether the estate owns the entire parcel or only an interest in it. Identify charges, restrictions and other registered owners. A proposal to distribute land should begin with what the deceased actually owned. Your lawyer needs the title position before assessing what can be transmitted or sold.
If physical division is proposed, explain access, existing buildings and current occupation. Supply any available survey or valuation records. Those practical matters can influence the options the family wishes to discuss, but they should not be mistaken for a completed subdivision approval or a final allocation of individual plots.

State whom the family proposes to carry out the order and why. Identify any disagreement about that role. An advocate should explain the difference between holding or implementing an estate interest and owning it personally. A trustee’s name on registration documents does not by itself answer the beneficial shares of the family.
Ask how the proposed representatives will keep records, communicate with beneficiaries and account for any sale proceeds. If the court has already appointed them, bring the signed order and any later directions. Do not assume an appointment gives unrestricted authority beyond the order and applicable legal requirements.
Review the order before implementing a sale or transfer
Where a decision authorises sale or transfer, establish exactly which property and interests it covers. Identify the intended transaction and obtain advice before commitments are made. Ask how each beneficiary’s interest will be reflected in the implementation documents. Keep the judgment, transaction papers and accounting records together.
For consultation, provide the current search, complete family chronology, competing proposals and all existing orders. State whether the question concerns entitlement, disagreement over an agreement or implementation by trustees. Nrangu shows why an equal-sharing proposal cannot be substituted for the final judgment. It does not establish the shares for a different family or resolve an entitlement omitted from its operative orders.
