In Athi Plains Holdings Limited v Kirsteen Holdings Limited & another, the Machakos ELC compared a purported lease, company-registration evidence and the legislation cited on the document. Those comparisons exposed the competing title account as fraudulent.
The claimant reconstructed the purchase and subdivisions
Athi Plains relied on its acquisition of L.R. 8784/1 in the Athi River area and the subsequent subdivision into 34 plots. It produced the mother title, transfer instrument, subdivision schedule and certificates issued in its own name.
The defendants’ asserted entitlement emerged through documents used in earlier Mavoko proceedings and in their response to an injunction application. Their occupation included construction, beaconing and other interference recorded in photographs.
The main suit proceeded without a defence or evidence from the defendants. The court nevertheless required the plaintiff to prove its claim; silence did not remove the civil burden of proof.
The company could not own land before incorporation
The competing certificate indicated registration in 2008. The plaintiff obtained company-registry material and a registrar’s letter showing that the first defendant was incorporated in June 2014.
At paragraphs 20–21, the judge found that the company could not lawfully have become owner six years before it came into existence. The corporate chronology directly contradicted the supposed acquisition account.
A Machakos land-fraud advocate should therefore compare the seller’s legal identity and incorporation history with every date on the acquisition documents. Matching a company name in a current search does not explain whether that entity existed when an earlier instrument was supposedly issued.
The legislation printed on the lease created another contradiction
The purported 2008 certificate referred to the Land Registration Act of 2012 and to the earlier Registered Land Act as repealed. The court found that wording incompatible with the stated issue date.
This was more than suspicion based on appearance. It was a chronological defect supported by the document itself and the legal history identified in the judgment.
The editorial lesson is to test the instrument against the legal framework operating at its alleged creation. A document’s seal or printed reference does not prevent its contents from contradicting its own date.
The plaintiff also proved its own lawful chain
Exposing the opponent’s documents was only part of the case. The plaintiff’s purchase, transfer and subdivision materials supplied a positive account of its own entitlement.
At paragraph 22, the court accepted that supported chain and found the defendants’ documents forged and fraudulent. The analysis should not imply that any defect in a competing certificate automatically gives land to whoever challenges it.
Photographs separately supported the trespass claim. They showed structures, felled trees, beaconing and wasting of the property, providing evidence of conduct as well as the disputed paperwork.
The orders protected the identified parcels
Paragraph 27 cancelled competing title or lease documents in the defendants’ names over the listed properties, declared the plaintiff the rightful owner and granted a permanent injunction.
The defendants were directed to vacate within 60 days, with default eviction supervised as necessary by the Officer Commanding Athi River Police Station. Costs were placed on the defendants.
The judgment did not award a separate construction-profit or market-loss damages figure. Nor does the civil fraud finding establish a criminal conviction or completion of the subsequent eviction process.

- Place the alleged issue date beside incorporation and name-change records.
- Identify the statute and registration system stated on each certificate.
- Obtain the authentic root, transfer and subdivision documents.
- Preserve the exact competing papers filed in earlier proceedings.
- Record physical interference independently through dated evidence.
These comparisons assist the lawyer in identifying which documents need registry confirmation and which witnesses can explain their origin. They are a preparation method, not a substitute for proof in the actual proceeding.
Frequently asked questions
Did absence of a defence guarantee judgment?
No. The court expressly assessed the plaintiff’s evidence and burden.
Was the 2008 company-ownership account accepted?
No. Official incorporation evidence placed the company’s creation in 2014.
Were all damages implied by the fraud finding?
No separate monetary damages award should be invented from these orders.
Reviewing an Athi River forged-title dispute
Give the property advocate both acquisition chains and the underlying registry evidence. A precise chronology can expose contradictions that a current search alone will not answer.
